James Arias comenzó su jugoso negocio con una bodega en un barrio de Bogotá donde compraba y revendía chatarra para ganarse el diario. Su trabajo tenía como epicentro la localidad de Kenedy, un barrio al sur de Bogotá, donde se concentran buena parte de las personas que se dedican al reciclaje en Bogotá. Tenía un pequeño negocio que fue creciendo paulatinamente con la compañía y el apoyo de su esposa Diana Ochoa, más que su compañera, su aliada más estratégica. James Arias terminó su carrera de zootecnista pero el negocio de la chatarra iba prosperando.
Su liderazgo lo llevó a agrupar a decenas de recicladores y en cuanto vio la oportunidad creó su propia empresa: en 1992 fundó Mundo Metal, una compañía que arrancó con un capital de $200 millones de pesos que había conseguido, recogiendo, vendiendo y revendiendo residuos de chatarra.
Gracias a su estrategia, más bien un coctel de evasión de impuestos; lavado de activos y recobros falsos de IVA, consiguió un crecimiento exponencial de su fortuna y de sus negocios. Para el 2008 fundó su segunda empresa, Metal Comercio, con un capital madre de $2 mil millones convirtiéndose en el empresario más poderoso del negocio de la chatarra moviendo más de medio billón de pesos en operaciones en todo Colombia y con exportaciones a 130 países cómo Panamá, Ecuador, China, España y Grecia, entre otros, siempre con un bajo perfil que lo mantuvo con los radares alejado de los medios. Los buenos resultados en sus balances financieros le permitieron, a sus 47 años, controlar el 60% del negocio de la chatarra en el país.
Pese a su fortuna y de tener más de cincuenta propiedades y socios en las altas esferas del poder, James Arias era un completo desconocido hasta que en marzo de 2015 el Presidente Juan Manuel Santos anticipó un golpe monumental contra una red de corrupción y evasores de impuestos. Aunque el Presidente no lo mencionó con nombre propio, en ese momento se supo que se trataba del ´´zar de la chatarra´´.
La investigación en su contra tenía un doble propósito, desmantelar su red de empresas con las que fraguó todo un plan para realizar exportaciones falsas de materiales de chatarra y recobros falsos de IVA, y la otra, seguirle la pista a dos empresarios con quienes había tenido relación comercial: los hermanos Tomás y Jerónimo, hijos del expresidente Álvaro Uribe.
Los hijos del expresidente comenzaron su vida empresarial durante su gobierno. El reciclaje fue la punta de lanza de un amplio portafolio de negocios que hoy controlan
Pero el primer intento de capturarlo fue fallido. James Arias estaba informado de las pesquisas de oficina del Zar Anticorrupción de la Presidencia Camilo Enciso y del Fiscal Eduardo Montealegre en su contra y logró evadir ese primer operativo en el que agentes del CTI intentaron capturarlo en marzo de 2015. James Arias logró escapar y el anunció anticipado del presidente Santos se vio frustrado.
Pero para el Fiscal Montealegre y para el gobierno, que dejó ver sus cartas mencionando el caso más de 18 veces en medios, Arias era un objetivo de alto valor y no estaban dispuestos a permitir que se les escabullera.
La Fiscalía emprendió su persecución hasta que en diciembre de 2015 logró capturarlo en una finca de Antioquia. Desde ese momento, se comenzó a mover paralelamente otro proceso en la Fiscalía: el de los hermanos Tomás y Jerónimo Uribe.
El zar de la chatarra cayó preso y los hermanos Uribe Moreno comenzaron a defenderse.
Pronto, ambos fueron vinculados a una investigación, llamados a rendir declaraciones y desde entonces se ha tranzado una guerra entre la Fiscalía y los Uribe Moreno a través de los medios y de su abogado el penalista Jaime Lombana.
James Arias fue capturado meses después de evadir un operativo del CTI. Se declaró culpable y firmó un principio de oportunidad que puede derivar en pruebas contra los Uribe Moreno
Aunque Tomás y Jerónimo no son socios de chatarrero James Arias en el pasado han realizado transacciones y negocios a través de su empresa Ecoeficiencia, una de las más grandes que compite en el mercado a gran escala de chatarra en Colombia. Ellos han reconocido esos negocios pero insisten en que ya fueron auditados por la DIAN sin encontrar ninguna irregularidad y recuerdan que del total de las operaciones de su empresa Ecoeficiencia entre 2005 y 2011, solamente el 2% de las mismas corresponden a negocios que hecho con James Arias.
Ellos, aseguran tener declaraciones escritas y juramentadas de personas que aseguran haber sido presionados desde la Presidencia de la República para que declaran en su contra y además están dispuestos a llevar su caso a instancias internacionales. Será uno de los argumentos que posiblemente utilice el expresidente en su gira por Europa que inicia el 27 de Junio donde además de hacer campaña contra la impunidad de las Farc intentará demostrar que sus hijos son objeto de una persecución judicial direccionada desde la Casa de Nariño.
Con el desarrollo del caso del zar de la chatarra James Arias la situación judicial se les complica cada vez más a los hermanos Tomás y Jerónimo. Como nunca antes, han tenido enfrentar la dificultad de tener encima a las autoridades pidiendo explicaciones sobre sus cuentas y sus movimientos empresariales. El chaterrero se declaró culpable de los delitos que lo acusa la Fiscalía y firmó un preacuerdo de cooperación con la Fiscalía con el cual podría salpicar a Tomás y a Jerónimo en una estrategia en la que la empresa del chatarrero y otras habrían actuado de forma coordinada para engañar a la DÍAN en los recobros del IVA y de otros impuestos. Aunque se trata de un tema tributario, de lograrse comprobar la participación de los hermanos Uribe Moreno en este caso, las repercusiones penales que en dado caso podrían llevarlos a la cárcel.
En sus últimos días en el cargo, el Fiscal Encargado Jorge Perdomo, quiere dejar documentadas las pruebas de una posible ilegalidad en sus negocios que podría llevarlos a responder penalmente y ya le dio un principio de oportunidad a James Arias por cuyos delitos confesos podría pagar 25 años de cárcel.
La última defensa de los Uribe Moreno fue anticipar que iban a ser objeto de un montaje. Hoy en diversas declaraciones en radio le salieron al paso a nuevas decisiones de la Fiscalía que se pueden configurar tras el preacuerdo firmado por el Chatarrero que al parecer tiene como piedra angular el compromisos de entregar pruebas de sus relaciones comerciales que hayan podido cruzarse con recobros fraudulentos de impuestos y negocios por fuera de la ley, colaboración que serviría para documentar le caso de los Uribe Moreno y le significarían una sustancial rebaja de su pena.
