Una serie de recomendaciones técnicas al contrato para actualizar el Plan de Ordenamiento y manejo de la cuenca hidrográfica del rio Loro, Las Ceibas y otros a que vierten al Magdalena, POMCA, hizo desde hace un año, La fundación, Comité Cívico Rio Ceibas, a la firma IMPRO S. A. S, representada por el ingenimero Eduardo Patarrollo Córdoba, encargada de ejecutar el millonario contrato, supervisado por la CAM.
El documento de 6 folios fue recibido por quien estaba dirigido, el 30 de diciembre del 2016 y contiene los siguientes ítems:
1-. Fortalecimiento de las organizaciones de la cuenta.
2-. Mercadeo y sistemas productivos sostenibles.
3-. Estructuración de sus propuestas de pago por servicios ambientales.
4-. Turismo de naturaleza y agroturismo.
5-. Sensibilización a la zona urbana.
6-. Usos integrales del suelo.
Cada ítem dispone, en el documento, de una explicación clara, concreta, precisa, exacta y concisa que debe tenerse en cuenta y aplicarse, para que el POMCA, sea una verdadera actualización y no simple refrendación al arcaico POMCA existente.
El texto cierra exigiendo, el estudio de reformulación debe tener en cuenta cual va a ser la fuente de financiación de las nuevas cuencas hidrográficas que se integran el nuevo plan de manejo y ordenación y, emitir un concepto sobre la viabilidad de la construcción de la vía Neiva-Platanillal- San Vicente del Caguán en el Caquetá.
POR QUÉ LAS RECOMENDACIONES
Los requerimiento de FUNCEIBAS, surgen y siguen vigentes, porque el POMCA (reformulado) es la carta de navegación sobre la que gira todo tipo de política de intervención de la cuenca, es decir, nada puede estar por encima de esa norma, tal como lo establece La Constitución Política de Colombia.
Por consiguiente el Alcalde ni el Concejo Municipal, pueden ejecutar o legislar sobre uso, manejo o destinación de la cuenca, que no esté contemplado en ese documento, hoy a punto de ser entregado a la Corporación Autónoma Regional – CAM – para revisión y socialización correspondiente.
Un gravísimo peligro que se cierne, es que el POMCA no defina, el uso del suelo o determine qué áreas no son posibles de adelantar intervención minera o, pase por alto la novísima formación de cordillera, la falla geológica que cruza la Cuenca y en esa forma se dé pie, para que continúe su deterioro acelerado, al antojo y albedrío de la avaricia minera oficial y privada.
La ausencia de este tipo de Plan de Manejo de cuenca, ha sido la causa por la que la Corte Suprema, Los Tribunales y otros órganos de control y vigilancia del Estado, deroguen disposiciones ordenanzales y acuerdos, sobre protección, como aconteció en Timaná, Íquira o el más reciente en Urrao, Antioquia.
