Ha circulado por medio de un mensaje masivo de WhatsApp, la noticia de la aprobación en nuestro país del derecho absoluto a la defensa sin ser procesado penalmente, que muchos han dado por cierto en medio de la pavorosa inseguridad ciudadana que tenemos, como un bálsamo para la protección personal, cuando la delincuencia desaforada ante la incompetencia e impotencia del Estado para contenerla, está dispuesta a matar sin contemplaciones para obtener el producto de su fechoría, sea de mucho o poco valor como lo vemos a diario en este trágico escenario de muerte y terror en que está convertida toda la geografía nacional.

Y de entrada, por supuesto, hay que decir que la noticia es falsa, porque no se puede consagrar la legítima defensa absoluta sin que se puedan considerar las circunstancias de su ejercicio, y menos en este país de asesinos impunes por esa misma incompetencia del Estado para judicializarlos y condenarlos, que acuden a cualquier motivo baladí para matar a otra persona, así resultara creíble la reforma, itero, por la inseguridad ciudadana del sálvese quien pueda que estamos padeciendo, porque sería regresar a las épocas de la barbarie de la ley del talión, que ya están aplicando lamentablemente como manifestación de la justicia privada, exactamente por la caótica inseguridad que el Estado no puede conjurar.

La legítima defensa se encuentra consagrada desde hace rato en nuestro violento país en el Código Penal en el artículo 32 como ausencia de responsabilidad, cuando se obre en determinadas circunstancias como un derecho fundamental en manifestación del ámbito de la seguridad ciudadana, que existe y ha existido en todas las sociedades para quien se defiende de un ataque grave o injusto contra su propia vida o la de un tercero, sin que se le pueda reprochar penalmente su conducta, permitida normalmente cuando el Estado mediante sus organismos de control no pueda auxiliar a un ciudadano de manera inmediata.

El problema de la situación actual de permanente y aterradora inseguridad ciudadana por la misma incompetencia del Estado, es que nos encontramos también en intemporal situación de indefensión ante un ataque delincuencial como los que padecemos todos los días sin que la autoridad lo pueda socorrer inmediatamente, que hace que prácticamente la legítima defensa se imponga por el ciudadano casi que en forma absoluta sin que tenga como hacerlo, porque los delincuentes se encuentran armados hasta los dientes y el aterrado ciudadano no tiene como ejercerla por las limitaciones existentes para portar un arma, así sea traumática, que ha llevado muchas veces a que cuando lo ha hecho, igualmente ha sido procesado por defenderse con un arma que no estaba legalizada, como le sucedió a un ciudadano que está encartado por este delito, mientras el delincuente que apenas resultó herido, se encuentra en la calle pero muerto de la risa por la incompetencia del Estado para garantizar la indispensable seguridad ciudadana con una política pública integral que no vemos, que ha obligado desgraciadamente y para colmo de males en este país de males, al ejercicio de la justicia privada.
