Después de que se filtrara una grabación en la que el gerente de RTVC pide la cabeza de Santiago Rivas, presentador de “Los puros criollos”, Bieri presentó su renuncia irrevocable. Expertos dicen que se trató de un acto de censura.
Si el presidente Iván Duque acepta la renuncia del periodista Juan Pablo Bieri tal como él la presentó, el próximo lunes éste dejará la gerencia de RTVC (Radio Televisión Nacional de Colombia), el sistema nacional de medios públicos, cargo en que se posesionó el 27 de agosto del año pasado. Su dimisión se dio luego de que La Liga contra el Silencio, una alianza que combate la censura, divulgó un audio que probaría que Bieri tuvo toda la intención de censurar a Santiago Rivas, presentador de Los puros criollos, un programa que se emite en Señal Colombia, canal que hace parte de RTVC, a raíz de las opiniones que Rivas manifestó en La Pulla, canal de opinión de El Espectador. Un asunto que abre un debate sobre la libertad de expresión en el país.
Todo comenzó el 6 de diciembre pasado, cuando Rivas sentó su postura en contra de un proyecto de ley del Ministerio de Tecnologías de la Información y las Comunicaciones (Mintic). A grandes rasgos, la iniciativa propone crear un “regulador único” para el sector de las comunicaciones —incluida la televisión— y la supresión de la actual Autoridad Nacional de Televisión (ANTV). El Gobierno defiende el proyecto con la tesis de que permitiría conectar a más de 20 millones de colombianos que aún no cuentan con el servicio de banda ancha y que, con su implementación, no se vería afectada una garantía constitucional como la libertad de expresión. Aunque el proyecto finalmente fue aplazado, este año se volvería a discutir en el Legislativo.
El mismo día en que se emitió La Pulla, RTVC retiró de la parrilla de programación en Señal Colombia las repeticiones del programa Los puros criollos. El 8 de diciembre, cuando las críticas por la decisión empezaron a surgir, Bieri rechazó públicamente “el señalamiento según el cual en RTVC se censura. Esta administración respeta la orientación de quienes allí participan y el enfoque del programa en la medida que se ajuste a lo contratado como ha ocurrido hasta ahora. En tal virtud, afirmar o sugerir que existió un acto de censura por pronunciamientos de su presentador (Rivas) sobre temas que nada tienen que ver con los contenidos de la serie, riñe totalmente con la realidad”.

Sin embargo, un audio obtenido por La Liga contra el Silencio dice todo lo contrario. La grabación, divulgada ayer por La Pulla, corresponde a una reunión realizada en RTVC el 6 de diciembre, el mismo día en que Santiago Rivas apareció en La Pulla. El audio deja entrever la molestia de Juan Pablo Bieri con la postura de Rivas en relación con el proyecto de ley de Mintic y revela su intención de sacar del aire a Los puros criollos. En ese acto, el gerente pidió detalles de la producción, como la hora de emisión del programa, la situación de la nueva temporada, el tipo de contrato de Rivas con RTVC y las fechas máximas para poner en el aire la nueva temporada, entre otros.
Este miércoles, la Fundación para la Libertad de Prensa (Flip) emitió un comunicado asegurando que el audio “prueba que el gerente de RTVC imparte estas órdenes a raíz del malestar que a él y a sus asesores le provocaron las opiniones públicas de Rivas”. Además de que, contrario a la voluntad de Bieri, los nuevos episodios de Los puros criollos se empezaron a emitir el pasado 16 de enero en prime time (horario de máxima audiencia). “El gerente de RTVC lideró un plan de retaliación contra Rivas con el propósito de censurar opiniones alternativas a las del Gobierno en el curso de deliberaciones sobre asuntos de alto interés público, como la reforma al sector de telecomunicaciones que actualmente impulsa el Mintic”, precisó la Flip.
Ante la enorme controversia que generó el audio, Juan Pablo Bieri contestó desde sus redes sociales que le preocupaba que su derecho a la privacidad se vulnerara con “chuzadas o grabaciones ilegales” y que fuera la Flip “quien impuls(ara) esa clase de prácticas”. “Obtener información de forma fraudulenta es un delito. Constreñimiento para delinquir agravado, entre otros”, añadió. Los hechos suscitados por Bieri, en relación con el programa Los puros criollos, ponen en debate el derecho a la libertad de expresarse. “La Flip no reveló el audio por sacar a Bieri. Lo reveló porque nuestro mandato es levantar la voz cuando haya censura. El foco tiene que ser la defensa de medios públicos para la democracia”, expresó Pedro Vaca, director de la Flip.

Para Vaca, Juan Pablo Bieri hizo lo correcto al renunciar a la gerencia de RTVC, pero cuestionó su reacción ante lo sucedido. “Lo reprochable acá fue su conducta y esa forma de ver el mundo con la gerencia de un sistema de medios públicos donde debe haber espacio para todas las voces sin discriminación alguna. Lo altruista, valiente y profesional fue el coraje de nuestra fuente y el trabajo de la Flip y la Liga Contra el Silencio. Bieri ve el mundo al revés e ilegalidades donde brilla la valentía, que sacó de la sombra un asunto relevante. Se pone camisetas heroicas que no le lucen”, añadió Vaca.
La Flip y la ministra del Mintic, Silvia Constaín, se reunieron ayer y coincidieron en que lo importante es que el país tenga un sistema de medios públicos con libertad de expresión. Para ello, la fundación entregará un informe al gobierno sobre el tema. Pedro Vaca sugirió una mesa técnica para socializar y discutir las controversias del proyecto de ley, pero se ofreció —por ahora— un correo electrónico para exponer las observaciones. “La ministra aseguró que todos los mensajes están siendo tomados en consideración”, concluyó el director de la Flip.
Carlos Arias, docente de la maestría de comunicación política de la Universidad Externado, le dijo a este diario que, contrario a lo que dice Bieri, en este caso sí existió un acto de censura. Por un lado, porque una declaración hecha por Rivas dio lugar a un acto de retaliación de Bieri contra Los puros criollos y contra el patrimonio público —pues se invirtieron recursos públicos en un producto audiovisual— y, por otro lado, porque con argumentos subjetivos se intentó sacar del aire una serie premiada y con gran audiencia. Para Arias, la grabación no debería considerarse ilegal “porque se genera en un espacio de una entidad pública, porque los temas son tratados por funcionarios públicos”.

Germán Ortiz, profesor del programa de periodismo y director del Observatorio para la Libertad de Expresión de la Universidad del Rosario, concuerda con Arias en el sentido de que lo hecho con Bieri fue censura. “Es censura cuando a uno lo mandan a callar por lo que uno expresa. Además, la conversación deja entrever que Rivas, al trabajar con RTVC, tiene que pensar como la empresa, aunque no se exprese explícitamente”. Ortiz explicó que no fue lo mejor haber grabado la conversación sin una aprobación, pero si no hubiera sido así la opinión pública no se habría enterado de lo que sucedió. “Es muy triste que alguien que era periodista esté en la palestra pública por un acto de censura”.
Las investigaciones en la Procuraduría contra Juan Pablo Bieri
En diciembre de 2018, la Procuraduría le abrió una investigación disciplinaria a Juan Pablo Bieri por supuestos actos de censura en Radio Nacional de Colombia. Las directivas de RTVC fueron señaladas de censurar a los periodistas Carlos Chica y Andrea Olano durante el espacio radial La señal de la mañana porque, al parecer, les pidieron abstenerse de hacerle preguntas al presidente Iván Duque durante una entrevista. En ese momento, el gerente de RTVC negó las acusaciones asegurando que “nunca se dio instrucción” para que dejaran de cuestionar al primer mandatario.
La mas reciente investigación disciplinaria contra Bieri tiene que ver con lo sucedido con Los puros criollos. En este caso, el Ministerio Público quiere establecer si existieron extralimitación de funciones, posibles actos de censura y vulneración del derecho a la libre expresión en contra de Santiago Rivas, presentador del programa. En ambos procesos, la Procuraduría ordenó la práctica de pruebas para verificar las conductas, sus autores y las circunstancias de tiempo, modo y lugar.
