Por Luis Fernando Pacheco Gutiérrez (La Gaitana).
El artículo 142 de la Ley 1448 de 2011 (conocida coloquialmente como la “Ley de Víctimas”) estableció que el 09 de abril se conmemoraría el Día Nacional de la Memoria y la Solidaridad con las Víctimas del conflicto armado. Como puede verse el día está atado a la fecha de 1948 en la que murió asesinado el líder político Jorge Eliécer Gaitán que se preveía el más probable sucesor de Mariano Ospina Pérez en la presidencia de Colombia dos años después.
A doce años de la promulgación de la Ley de Víctimas el balance es un sinsabor. La situación es mejor que en la primera década de este siglo pero el panorama es mucho más pesimista de lo que esperaban los analistas y sobre todo las víctimas.

Tras el fracaso de los diálogos del Caguán y el triunfo de Álvaro Uribe en las urnas en 2002 se empezó a difundir en los círculos de poder un relato negacionista: en Colombia no había conflicto armado, sino una amenaza terrorista que debía ser combatida con toda la fuerza del Estado.
Ese relato implícitamente negaba la condición de víctimas en el sentido clásico del Derecho Internacional Humanitario, invisibilizaba las afectaciones provenientes de actores estatales y no valoraba integralmente los entresijos de una guerra donde no había buenos y malos. Por si lo anterior fuese poco, desde ese punto de vista la responsabilidad del Estado sólo podía ser reclamada judicialmente ante los tribunales y en los casos establecidos por la jurisdicción contencioso-administrativa. En términos más coloquiales, la impunidad reinaba y la reparación era un asunto de la justicia, para quien pudiese llegar a ella.

Por eso, cuando de manera sorpresiva el Gobierno Santos incorporó en su agenda legislativa una Ley que buscaba reparar administrativamente a las víctimas del conflicto armado y que, evidentemente, lo admitía, una luz brilló en el camino de casi diez millones de compatriotas que habían sido tocados por el horror de una guerra.
Aunque la Ley consideró el 9 de abril como homenaje a ese parteaguas que marcó un nuevo periodo de violencia desatada que solo menguaría tras el nacimiento del Frente Nacional, también es cierto que estableció el año de 1985 para la reparación administrativa: es decir, solo aquellos hechos victimizantes sucedidos después de esa fecha podrían ser reparados en términos económicos.

Más allá de la reparación administrativa, la nueva norma elevó el antiguo Grupo de Memoria Histórica a un Centro de Memoria que rescatara del olvido esos hechos de horror que habían marcado la historia del país, estableció un día conmemorativo, pero sobre todo desarrolló la estructura institucional para cumplir los mandatos que ya la Corte Constitucional había destacado. Por ejemplo, en materia de desplazamiento forzado nacía así la Unidad Administrativa para la Reparación Integral a las Víctimas, antes UARIV y hoy conocida sencillamente como Unidad para las Víctimas. También previó escenarios de participación democrática y plural para las víctimas, lo que con su regulación posterior devino en las actuales Mesas de Víctimas que existen en todos los niveles territoriales y que cuentan con incentivos (mínimos, pero inexistentes en otros escenarios) que garantizan sus protocolos y Planes de Acción.
Expertos de diversas geografías resaltaron la norma como pionera en la materia y si se quiere profética, puesto que, de manera excepcional surgía antes de un proceso de paz (el diálogo con las FARC solo concluiría cinco años después). La ley tendría de entrada una vigencia de diez años para lograr su cumplimiento.

Sin embargo, pasada la primera mitad de vigencia de la Ley, era ya notorio el hecho de que diez años no serían suficientes para alcanzar un mínimo de protección y restablecimiento de derechos para casi diez millones de víctimas acreditadas en todo el país (solo a partir de 1985). Además, porque el estado de cosas inconstitucionales que la Corte había declarado en 2004 destacaba que existían fallas sistémicas que no se solucionarían ni siquiera con la reparación indemnizatoria sino que requería que las víctimas lograran sentir que sus vidas se adaptaban completamente a unos entornos que la violencia había roto. Por todo lo anterior, el legislativo tomó la decisión en 2021 de prorrogar la Ley de Víctimas por diez años más. Han pasado solo dos años de esa primera prórroga y en el Palacio de Nariño gobierna por primera vez un gobierno de izquierda. Sin embargo, la perspectiva sigue siendo ambivalente.
Aunque la propuesta de Plan Nacional de Desarrollo denominada “Colombia: potencia mundial de la vida” consagra por primera vez un capítulo dedicado a las víctimas del conflicto armado y prioriza la reparación, además de buscar avanzar en el problema de la tierra (lo que implicaría una real política de retorno para aquellas víctimas que así lo deseen) hay muchos vacíos sobre el cómo y una enciclopedia de temas ausentes que preocupan: la salud mental, como una de las más graves afectaciones no aparece reflejada como una política pública, el clamor de las víctimas por opciones de educación superior gratuita se debe entender recogida dentro de esta propuesta amplia pero sin valorar las condiciones especiales de esta población vulnerable y la demanda de vivienda para tantos y tantas que ya no ven probable regresar a sus territorios (entre otros temas, porque ya pasó una generación de sus desplazamientos en muchos casos) sigue siendo un clamor sin réplica.

En breve resumen, hoy conmemoramos a nuestra memoria y a nuestros compatriotas víctimas de una violencia sin sentido con un sabor agridulce: estamos mucho mejor que antes de la Ley 1448 de 2011, pero lejos aún de la situación ideal de quienes creen que es posible pasar la página del horror y convertirse más que víctimas en supervivientes del dolor. Lo que nos queda como sociedad es un largo camino por recorrer.
