La construcción de la Hidroeléctrica El Quimbo, en el sitio en que esta, ocurrió por una decisión tomada en un COMPES, sin análisis sustentable de conveniencia, técnica, económica y ambiental.
De acuerdo con Hidroestudios S.A, el fin encubierto por la multinacional EMGESA, era recuperar el potencial perdido en la Central Hidroeléctrica Betania, potencial minimizado abruptamente, por sedimentación del área del embalse. Conseguir esa meta no era difícil. El gobernante era Uribe Vélez, compulsivo por las privatizaciones y la concentración del capital. En su gobierno fueron privatizadas, fusionadas o liquidadas, más de 500 empresas oficiales.
Los eventos informativos efectuados en la Cámara de Comercio de Neiva, sobre el Proyecto EL QUIMBO, durante 2008, mostraron que los asistentes, eran invitados de piedra. Oían a los forasteros. No opinaban. Creo que estaban decididos a dejar hacer, dejar pasar, como es costumbre en la región. Ese clima quedó consumado en un Conejo Comunal, de los se acostumbró hacer el Sr. Uribe, para disfrazar su populismo apabullante. Ante una pregunta sobre El Quimbo, respondió, palabras más palabras menos, que ese proyecto iba o iba.
Esa respuesta y la posición de letargo y sumisión de los representantes de las fuerzas vivas de la región y de gobernantes, me hizo pensar que, para lograr algún beneficio para la región, devenido del negocio de la Hidroeléctrica El Quimbo.
solo podría ser posible, mediante el uso de recursos legales, previstos en la Constitución del 91 y entonces comencé a pensar en la Acción Popular.
Bajo esas condiciones, redacté el contenido de la Acción Popular referido, sin consultar a nadie más, que los aspectos legales que la rigen. Ya redactada, y comentada con unas pocas personas, se propició una reunión, a la que desafortunadamente concurrieron un par de politiqueros pura sangre, de esos que siempre hacen más daño que bien a la comunidad, pero que desafortunadamente el pueblo sigue escuchándolos. Di a conocer el contenido, en una reunión de algunas personas que mostraron interés en el tema. En esa reunión apareció un politiquero de oficio, Beltrán Cuéllar, quien ofreció acompañarla con su firma, la firmó, logró pisar pantalla y se retiró, sin interesarle en adelante, la suerte de la demanda.
Radiqué la demanda en noviembre de 2008, formulada contra Ministerio de Minas y Energía, Planeación Nacional, Minmedioambiente, ANLA, CAM y EMGESA, de la que hubo finalmente Sentencia del Tribunal Administrativo del Huila, sobre derechos legales y legítimos de ciudadanos y la región, a finales del pasado mes de agosto.
Esa sentencia corresponde a la Acción Popular que interpuse en 2008, con el propósito de lograr algunos beneficios papa le región, con fundamento en derechos constitucionales, debido a que conforme la impuso Uribe Vélez, solo benéfica al capital transnacional y conculca soberanía sobre una extensa área del territorio nacional. Así es necesario verlo y cuantificarlo.
Por reparto llegó al Juzgado 3° Administrativo. Ahí comenzó el curso de trámite. Pocos días después de radicada. Ese Juzgado exigió subsanación de algunos contenidos. Hice la subsanación. La radiqué. La demanda fue admitida. Posteriormente radique una adición sobre precisiones del contenido, en enero de 2009. Fui cubriendo algunos gastos de comunicación-citaciones del Juzgado y un edicto.
Meses después, se realizó la diligencia de conciliación y continuó el proceso. Por competencia pasó al Tribunal Administrativo del Huila, hasta la Sentencia del 20 de agosto de 2020.
Durante 12 años he hecho seguimiento continuo del avance del proceso jurídico, bajo sigilo personal, hasta la culminación en Sentencia. Consideré que era conveniente tener prudencia y evitar la especulación. El hacho es que en procura del objeto de la demanda ya hay Sentencia, que, aunque algunas personas no valoren el paso dado, por lo menos se abren expectativas. Esta Sentencia abre las puertas para mejorar las posibilidades del desarrollo diverso y efectivo del Huila, si se defienden los objetivos previstos y el resultado se usa honestamente.
Bajo las definiciones de la Sentencia, en particular en lo referente a la toma de agua del embalse, a la altura de la cota 641, es posible usar agua del embalse para abastecimiento de agua para consumo humano, aguas abajo de la Presa. Para ese propósito, hice cálculos hidráulicos básicos, sobre factibilidad para la construcción del acueducto metropolitano del Huila, para abastecer con seguridad, en lo futuro, a Hobo, Yagurá, Campoalegre, Rivera, Neiva, Fortalecillas, Aipe, Villavieja e intermedias, lo que es posible todo por gravedad. Es preciso decir que todos esos municipios y caseríos intermedios, ya afrontan agudos racionamientos en verano, por la creciente reducción de los caudales de las fuentes superficiales que los alimentas.
Este es un proyecto para el corto, mediano y largo plazo. Es para la seguridad del abastecimiento de agua, por gravedad, para las generaciones futuras, quizá por siglos.
Respecto al caudal para uso agropecuario, permite desarrollar múltiples y fantásticos proyectos de desarrollo productivo, si cada uno de ellos se fundamenta en previsiones y visión futurista, rigor técnico, sentido de inclusión y solidaridad humana, honestidad, soporte técnico-científico y se le cierra toda posibilidad de acción a la politiquería, el clientelismo, la corrupción. Este es un gran desafío, porque la politiquería y la corrupción, la inmoralidad e irresponsabilidad política de la clase dirigente, ha sumido a la nación en estado de precariedad socioeconómica aguda.
Las características geomorfológicas y altimétricas, de las áreas en las que se pueden proyectar desarrollos productivos de diversa índole y de reforestación, permiten optimizar el uso y re-uso del agua, tanto en piscicultura, como en la agro-industria, reforestación y diversificación de la producción agropecuaria, en más de 50.000 hectáreas. No es poca cosa. El resultado depende del bueno o mal uso que se haga de la oportunidad que se puede concretar si se defienden los alcances de la Sentencia.
Se pueden construir miles de lagos, basados en el re-uso del agua y de esa manera constituir un enjambre de lagos, rodeados de bosques que definirán o integrarán el OASIS DEL ALTO MAGDALENA, matizado de bosques y en el que pueden y deben estar incluidos todos los desplazados por el embalse del sistema Hidroeléctrico El Quimbo. Pensemos, soñemos y actuemos para traducir la oportunidad en realidad.
Debemos constituir un comité para la defensa de las compensaciones que pueden lograrse con el buen uso del agua que se tome de la cota 641 (m.s.n.m). De esa manera la fatalidad, que en principio se previó con la imposición de la Hidroeléctrica El Quimbo, puede transformarse en opción de desarrollo de la región y participación ciudadana. Todo depende de quienes asuman responsabilidades, en el desarrollo de los proyectos.
El desarrollo piscícola, con agua tomada en la cota 641, debe incluir a la mayor cantidad de personas desplazadas por la central hidroeléctrica, incluidas las de las áreas de influencia directa del sistema hidroeléctrico. Considero que será posible si se opta por sistema cooperativo, complementado con producción frutícola con inclusión de valor agregado.
Los fatalistas sobre los resultados y alcances de la Sentencia, es conveniente que analicen con paciencia e imaginación las perspectivas abiertas, busquen apoyos constructivos en el conocimiento y experiencias, para que puedan visualizar lo posible de lograr, sin mezquindad, sin caprichos, sin presbicia, sin arrogancias, ni pesimismo. “Quien resigna a ser oruga, renuncia al derecho que tiene de protestar si lo aplastan” (J.
