El mico más visible
Hace dos años, el gobierno radicó en el Senado el proyecto 341 de 2020, la llamada “ley anticorrupción”. El 7 de diciembre, la plenaria de la Cámara la aprobó en último debate, de manera que pasó a conciliación con el Senado y posterior sanción presidencial.
Como explica Mario Morales en esta misma edición; el artículo 68 de esta ley censura las denuncias contra funcionarios o exfuncionarios públicos. Obligado por la presión social, el presidente anunció en Twitter que, de llegar a su despacho, objetará ese artículo porque amenaza la libertad de prensa.
Pero esa no es la única disposición perjudicial que contiene el proyecto. La discusión sobre el “artículo mordaza” ha opacado otros “micos” cuya aprobación también será nociva para el país.
Qué dice la ley
El proyecto de ley original tenía dos propuestas buenas y muchas malas.
Las propuestas buenas consistían en medidas de protección para quienes denunciaran hechos de corrupción y en mejor control por parte de las superintendencias a las empresas que se benefician de la corrupción.
Las propuestas malas provinieron del acucioso oportunismo de los órganos de control y consistían en ampliar sus poderes y recursos.
La discusión sobre el “artículo mordaza” ha opacado otros “micos” cuya aprobación también será nociva para el país.
El texto definitivo del proyecto, que aprobó el Congreso, dejó intactas las propuestas malas y mutiló las buenas. Aunque se incluyeron medidas de control preventivo por parte de las superintendencias, se eliminó de tajo el capítulo sobre la protección para quienes denunciaran hechos de corrupción. Por último, los representantes Lorduy, Burgos y Villamizar incorporaron el famoso “artículo mordaza”, movidos por su solidaridad con la exministra Karen Abudinen.
El balance de esta ley es el mismo al que nos tiene acostumbrados la clase política que dirige el país: en nombre de la lucha contra la corrupción, el Congreso le dijo si a la corrupción.
Lo bueno que no fue
El primer capítulo del proyecto original contenía siete artículos con medidas de protección para quienes denunciaran o informaran sobre actos de corrupción, especialmente dirigido a funcionarios públicos y empleados de empresas privadas.
Allí se proponía incorporar a los colaboradores efectivos de la justicia al programa de protección de testigos de la Fiscalía y a los programas especiales de la Unidad Nacional de Protección. A estos testigos se les protegería su identidad y su empleo y se les garantizarían otras prerrogativas.
Pero quienes redactaron este artículo cometieron una omisión grave y probablemente deliberada: dejaron por fuera a quienes denunciaran delitos electorales, tales como constreñimiento, fraude y corrupción al sufragante, favorecimiento de voto fraudulento, fraude en inscripción de cédulas o alteración de resultados electorales.
En todo caso, el capítulo incluía medidas en la dirección correcta, pues atendían las recomendaciones de buenas prácticas para la protección de testigos en procesos penales relacionados con la delincuencia organizada. Esta estrategia fue diseñada y ha sido impulsada por la Oficina de Naciones Unidas contra la Droga y el Delito.
Desde luego, al Congreso no le interesa patrocinar la denuncia de estos delitos. Por eso optó por eliminar todo el capítulo del proyecto. Una vez más, queda claro que no existe poder que pueda afectar los intereses de los congresistas.
El oportunismo de la Fiscalía
El artículo 10 de la ley autoriza a la Fiscalía para enajenar de forma temprana los bienes sujetos a medidas cautelares –decomiso o confiscación– que hagan parte del Fondo Especial para la Administración de Bienes.
El afán de monetizar los bienes incautados a las mafías es consecuencia del incentivo perverso que estableció el artículo 10 de la Ley 1615 de 2013, que destina estos recursos a apoyar a la misma Fiscalía en proyectos de inversión de infraestructura, tecnología y mobiliario, entre otros.
La inclusión de esta norma por iniciativa de la Fiscalía es oportunista y traerá inconvenientes en el futuro. Es probable que esta figura de “enajenación temprana” resulte en problemas de orden jurídico, como ya lo analizó en 2019 la tesis de grado de Mónica Rodríguez. Además, puede derivar en más hechos de corrupción, como señaló la Contraloría en 2015.
Vender un bien incautado a la mafia, amparados en una medida cautelar y no en la extinción de dominio, es muy riesgoso para la Fiscalía. La finalidad de la medida cautelar es conservar el bien para asegurar el debido proceso y el acceso a la administración de justicia. Esta intención se frustra cuando el bien se enajena de forma temprana. Hay además que recordar que esa enajenación temprana fue una de las razones que incentivó la corrupción en la extinta Dirección Nacional de Estupefacientes.
No hay que perder de vista que los jueces han condenado a la Fiscalía en innumerables procesos por un manejo erróneo de su misión. Hoy la Fiscalía acumula 2,6 billones de pesos en cuentas por pagar por litigios pérdidos. Adicionalmente, esta institución tiene copiosos procesos en curso ante la jurisdicción de lo contencioso administrativo, cuyas pretensiones superan los 26 billones de pesos.
El manotazo de la Procuraduría
El Decreto 2170 de 1992 suprimió el Fondo Nacional de Bienestar Social y destinó las multas por sanciones disciplinarias a financiar el bienestar social de los empleados de las respectivas entidades públicas a las que pertenezcan los sancionados y multados.
El artículo 38 de la ley anticorrupción cambió la destinación del 80% de estos recursos para financiar el “Fondo Especial para el Fortalecimiento del Ministerio Público”. Este Fondo invertirá en el control disciplinario, la vigilancia superior con fines preventivos y las demás acciones destinadas a combatir la corrupción, dice el artículo.
En otras palabras, la Procuraduría cayó en la misma trampa de la Fiscalía: se creó un incentivo perverso que mercantiliza los procesos disciplinarios y le pone a las sanciones fines de lucro.
La Contraloría mete su mico
Por otra parte, el artículo 37 del proyecto amplía el poder del contralor para procesar fiscalmente a “los particulares que participen, concurran, incidan o contribuyan directa o indirectamente en la producción de daños al patrimonio público y que, sin ser gestores fiscales, con su acción dolosa o gravemente culposa ocasionen daños a los bienes públicos inmuebles o muebles”.
Esta medida permitiría utilizar todo el aparataje del Estado para intimidar, reprimir y judicializar a los jóvenes que protestan.
El “mico” de la Auditoría General
El artículo 35 establece que la Auditoría General de la República podrá conceder beneficios a las personas que hayan participado en daños al patrimonio público si colaboran con información que permita esclarecer los hechos. Así sucede actualmente en la Contraloría General de la República, en virtud de los artículos 145 al 148 del Decreto Ley 403 de 2020.
Ello se traduce en que los contralores territoriales con procesos de responsabilidad fiscal vigentes ante la Auditoría General de la República, pueden clausurar la acción fiscal en su contra si colaboran en el esclarecimiento de los hechos que causaron daño al patrimonio público.
Para comprender las implicaciones de este artículo debe tenerse en cuenta que la actual auditora fue contralora departamental del Valle entre 2004 y 2008 y contralora general de Santiago de Cali entre 2008 y 2010.
Otros dos simios
Además, la ley anticorrupción incluyó otros dos micos:
- Eliminó las causales que permiten calificar la culpa grave de los funcionarios públicos que vulneran la ley o los derechos humanos; y
- Cambió las reglas de la acción de repetición –que permite cobrarle a un funcionario los recursos que paga el Estado por su culpa– para beneficiar a un grupo de personas.
El primer mico está en el artículo 40 del proyecto. En él se eliminan del artículo 6 de la Ley 678 de 2001 las cuatro causales taxativas que permitían presumir la culpa grave de los agentes del Estado en los procesos de acción de repetición. Esto es particularmente escandaloso si se tiene en cuenta que la causal cuarta era “violar el debido proceso en lo referente a detenciones arbitrarias y dilación en los términos procesales con detención física o corporal”.
Para decirlo en otras palabras, el Congreso les dio vía libre a los agentes del Estado para que vulneren los derechos humanos sin consecuencias judiciales. Eso tiene otra consecuencia adicional: cuando el Estado sea condenado por los excesos de la Policía y la Fiscalía en el manejo de la protesta social, los contribuyentes tendremos que asumir ese pago, pues habrá dificultades para cobrarle al funcionario culpable.
El segundo mico está en los artículos 48 y 49 de la ley. Allí se gradúa la responsabilidad de los funcionarios culpables en los procesos de repetición, según su salario y su patrimonio. Esto contradice la jurisprudencia de la Corte Constitucional, según la cual la acción de repetición tiene el “único propósito de reintegrar a las arcas públicas el valor de la condena que hubo de pagar [el Estado]”.
Además, de forma tramposa, se excluye a los funcionarios que tengan un patrimonio superior a 300 salarios mínimos, pues se establece que “si el sujeto de repetición (…) tiene un patrimonio igual a 300 SMMLV podrá llegarse a un acuerdo en el cual este se compromete a realizar un pago mínimo correspondiente al 80% de lo pretendido en su contra”. Al omitir decir “igual o superior”, se excluye a los funcionarios con más patrimonio y que, por lo tanto, tienen más capacidad de pago.
Con todo lo anterior, queda claro que el “artículo mordaza” era apenas la punta del iceberg. El daño a la libertad de prensa tal vez será evitado con la objeción del presidente Duque, pero los otros daños los pagaremos los contribuyentes, las personas abusadas por las autoridades y los jóvenes que miran el ejemplo de quienes ocupan las más altas posiciones del Estado.
