Las fosas donde reposan alrededor de 300 cuerpos de personas no identificadas en el Cementerio Central de Neiva cuya inhumación corresponde con las épocas recientes más álgidas del conflicto armado, quedaron bajo medidas cautelares.
Esa protección la debe ejercer la gobernación del Huila, a la Alcaldía y a la Diócesis de Neiva, de acuerdo con determinación de La Sección de Ausencia de Reconocimiento, Verdad y Responsabilidad de la Jurisdicción Especial para la Paz, dentro del trámite de adopción de medidas cautelares sobre el Cementerio Central de la ciudad.
La Jurisdicción Especial para la Paz – JEP – inició el estudio de medidas cautelares a partir de la solicitud de la Alcaldía de Neiva.
PRONUNCIAMIENTO
La Sección de Ausencia de Reconocimiento de la JEP adelanta el trámite con ocasión de una comunicación enviada a la JEP el 15 de octubre de 2019, por el Jefe de la Oficina de Paz y Derechos Humanos de Neiva, en la cual pone en conocimiento de la Jurisdicción la existencia de más de 300 cuerpos de personas no identificadas en el Cementerio Central de Neiva cuya inhumación corresponde “con las épocas recientes más álgidas del conflicto armado”.
El 4 de diciembre de 2019, la JEP emitió el auto AT-094 mediante el cual se inició el trámite de estudio de medidas cautelares para asegurar la protección y conservación de los cuerpos de personas no identificadas inhumadas en el Cementerio Central de Neiva.
A su vez, el 29 de enero de 2020, la Sección decidió asignar la sustanciación de este asunto a la Sala Dual conformada por los magistrados Alejandro Ramelli Arteaga y Gustavo Salazar Arbeláez.
El objeto de la medida cautelar es lograr la protección de los cuerpos ubicados en el cementerio con el fin de asegurar su posterior identificación y entrega.
Con base en la información recaudada por la Sección de Ausencia de Reconocimiento hasta la fecha, se pudo establecer la existencia de un proyecto de ajuste al Plan de Ordenamiento Territorial de la ciudad, que implicaría el traslado del Cementerio Central. Dado que la administración del camposanto está en cabeza de la Diócesis de Neiva, y que en virtud de la normatividad vigente la Alcaldía de la ciudad y la Gobernación del departamento tienen obligaciones de control y supervisión sobre los lugares de inhumación de personas no identificadas, la JEP los vinculó al trámite y se les requiere para que informen sobre el cumplimiento de sus obligaciones con respecto al Cementerio.
