El rezago del desarrollo integral nacional, es desconcertante. Los efectos catastróficos. Durante más de 200 años de vida independiente, sus gobernantes, en general, demostraron irresponsabilidad política y social absolutas. Lo único que se desarrolló, consolidó y sofisticó, fue la politiquería, el clientelismo, la corrupción y la impunidad.
Colombia necesita reformas radicales y racionales, para revertir el atraso socioeconómico, intelectual, cultural, tecnológico y científico y para poder integrase al concierto de naciones desarrolladas.

Es imprescindible extirpar el cáncer de la corrupción. Es posible extirparlo. Se requiere voluntad y decisiones de quienes ejercen el poder, en particular del Jefe del gobierno y el Congreso y los aportes y presión ciudadana.
La corrupción en el manejo de los recursos públicos, por los niveles alcanzados, da la impresión que se institucionalizó, en Colombia. Los gobiernos, quizá por conveniencia, dan palos de ciegos, cuando plantean soluciones al respecto.
Antes que reducir la corrupción, los hechos demuestran que el flagelo crece, hasta impactar toda la geografía nacional. Desafortunadamente, con el concurso, aceptación y tolerancia del sector privado y con el estímulo tácito de la debilidad e impunidad institucional.
Donde se coloca el dedo sale pus, expresó en 2013 el presidente colombiano, de ese periodo, al referirse al flagelo de la corrupción. Pero nada hizo para extirpar el cáncer y hasta el presente no encuentran antídoto para esa infección ética, moral, social y fiscal.

Ese es el cáncer socioeconómico-fiscal que socava e impide el desarrollo integral nacional.
De acuerdo con conclusiones de entes de control e investigaciones particulares recientes, el estado pierde o se deja robar de los corruptos, más de $60 billones anules, equivalentes a tres reformas tributarias, como la recientemente aprobada.
El flagelo de la corrupción, sí es posible erradicarlo. Se requieren reglamentos precisos, reguladores de la contratación y administración pública y un régimen de sanciones contundentes y sumarias, para los responsables de actos de corrupción.

Para viabilizar el desarrollo nacional, es imprescindible adoptar un Estatuto Único de Contratación, obligatorio para todas las entidades que manejan recursos públicos y contratan obras y servicios. Debe ser concreto, preciso y racional, no como el sofisma del llamado “Pliego Único”, con el “Mico” de la puntuación para la selección de proponente y restringido a infraestructura vial, los tales SECOP, Compra Eficiente y demás instrumentos engañosos. Son simples sofisma de distracción.
El Estatuto de Contratación debe precisar y ordenar que, todo funcionario y/o proponente denunciado por actos de corrupción debe ser separado del cargo, suspendido su contrato, a partir de la apertura de la investigación.

El funcionario público y el contratista, como persona natural o los socios de persona jurídica, declarados culpables, y los integrantes de consorcios, deben ser inhabilitado indefinidamente para contratar con entidad pública, en consorcio, unión temporal o integrante de persona jurídica. Además, todo investigado por actos de corrupción, debe ser investigado, de oficio, por enriquecimiento ilícito.
Las condiciones para participar en convocatorias para contratar con el estado, deben garantizar amplia participación de potenciales proponentes.
La evaluación y clasificación de propuestas, solo debe hacerse por cumplimiento de requisitos habilitantes, sin puntajes en todos los casos.
Debe haber mínimo cinco propuestas hábiles, como resultado de la evaluación, en toda convocatoria. En caso contrario debe repetirse el proceso.
La adjudicación debe hacerse solamente con balotas, entre los proponentes habilitados.
De interés: Dependencia político-económica y crisis social
Toda entidad oficial, que contrate obras o servicios, debe disponer de estudios y diseños, presupuesto calculado con base en precios unitarios actualizados anualmente y debe someterlos a aprobación de la Contraloría General de la República, anualmente. ¿Por qué reglamentación, condiciones y medidas como las sugeridas no las convierten en ley de la república?
Lo que se plantea y sugiere aquí, es sencillo de precisar y aplicar, pero tiene abierta oposición de politiqueros, clientelistas, burócratas y delincuentes de cuello blanco y congresistas.
Por las actitudes, posición e indiferencia de congresistas y por la percepción y resultados de debates y aprobación de normas de control contra la corrupción, debe concluirse que la única vía rápida para implementar cambios concretos en el sistema de contratación pública, sobre pliegos de condiciones, evaluación de propuestas y adjudicación de contratos, solo puede ser posible mediante facultades extraordinarias otorgadas al Sr. Presidente de la República, para que con apoyo irrestricto de los Entes Nacionales de Control, estructure y promulgue un nuevo Estatuto General de la Contratación, mediante Decreto Ley, que contenga disposiciones como las sugeridas.

Si le son negadas las facultades extraordinarias, el presidente, a través de organizaciones sociales y/o gremios defensores del bien público, deben convocar y tramitar un referendo, para estructurar el régimen de contratación pública. En el mimo decreto ley o referendo, debe derogar toda la normatividad sobre contratación vigente. Debe precisar procedimientos, términos y controles, que acaben con todas las mañas que están utilizando ordenadores del gasto y proponentes, para saquear el presupuesto público, a través de la contratación, aplicable a toda entidad que maneje dineros públicos, sin ninguna excepción.
La contratación pública es la vena rota del fisco nacional, no debemos ocultarlo.

La estructuración de ese Nuevo Estatuto, debe hacerla una comisión especial, integrada por personas de amplio conocimiento y experiencia en análisis de costos, especificaciones técnicas, programación de inversión y desarrollo de proyectos, entre otros.
Es un asunto de interés nacional, de tanta trascendencia, que no se debe confiar solamente a abogados, economistas, administradores, filósofos, poetas, artistas, lagartos, politiqueros y habituales burócratas paracaidistas. Es un asunte específicamente técnico, en el que debe imperar el interés general, la ética y la moral.
Debió ser la primera decisión del presidente Petro. Solicitar facultades extraordinarias al Congreso, el 7 de agosto de 2022, para decretar un Nuevo Estatuto de Contratación Nacional.
