El fiscal general de la nación, Francisco Barbosa, debe declararse impedido y pedir a la Corte Suprema de Justicia que elija a un fiscal ad hoc para tramitar una denuncia que llegó a su correo electrónico. Se trata de un escrito anónimo que contiene información sobre un posible delito de una antigua funcionaria.
Existe amplia jurisprudencia que señala que una denuncia anónima debe ser tramitada si tiene visos de credibilidad. Aparentemente la denuncia tiene fundamento, el problema consiste en que la denunciada es la esposa del fiscal Barbosa.

Para situarlos en el contexto quiero contarles quién es la esposa del señor fiscal. Se llama Walfa Constanza Téllez Duarte y fue contralora delegada para el medio ambiente. Esto sucedió en una época en que la esposa del contralor trabajaba para el fiscal y la esposa del fiscal para el contralor. Un alegre intercambio de parejas, en lo burocrático, que alcanzó su momento de mayor notoriedad cuando en un puente festivo –en plena pandemia—los cuatro se fueron para San Andrés en “visita oficial” pero con familias, hicieron abrir almacenes que estaban cerrados por la pandemia y el fiscal Barbosa aprovechó para presentarse ante los sanandresanos como “el segundo cargo más importante de la nación”. La historia del paseo la contó Noticias Uno.
La visita a San Andrés tenía tan poco de oficial que el contralor se regresó con la funcionaria de la Fiscalía y el fiscal se quedó con la contralora. En efecto, el contralor Felipe Córdoba volvió a Bogotá con su esposa la directora ejecutiva de la Fiscalía a bordo de un avión ejecutivo de la Policía. Mientras tanto el fiscal Francisco Barbosa se quedó más tiempo disfrutando el archipiélago con su esposa Walfa Téllez, contralora delegada para Medio Ambiente, y su hija adolescente acompañada por una amiguita. La feliz familia volvió a la capital en el Learjet de la Fiscalía.

Cuando al fiscal Barbosa le preguntaron por la evidente indelicadeza en el uso de recursos públicos para llevar de paseo a su familia, respondió: “Primero que fiscal general soy padre”.
Sin embargo, no es ese el tema que tiene en apuros al fiscal Barbosa y a su esposa Walfa. Este empezó unos meses después del paseo. Y fue impecablemente investigado por el periodista Juan Pablo Barrientos para Caracol.
Como contralora delegada para medio ambiente doña Walfa Téllez presentó en diciembre de 2020 un informe de auditoría sobre la planta de tratamiento de aguas residuales Salitre y Canoas, construida para limpiar una parte del río Bogotá. En el informe, doña Walfa reseñó 17 hallazgos administrativos y estableció un plan de mejoramiento para superar esas irregularidades.

Poco después de haber remitido el informe de auditoría, doña Walfa, la esposa del fiscal Barbosa, renunció a la Contraloría y en junio, menos de seis meses después, fue inscrita en la Cámara de Comercio una fundación llamada Ríos Sostenibles.
Nada tendría eso de particular si no fuera porque la Fundación Ríos Sostenibles tiene como directora ejecutiva a doña Walfa Téllez y suscribió un contrato por 190 millones de pesos con la Planta de Tratamiento de Aguas Residuales Salitre Canoas para prestarle asesoría ambiental y jurídica. Es decir, la fundación para la que ahora trabaja doña Walfa asesorará a la misma planta sobre la que ella ejercía control fiscal como delegada de la Contraloría.

Por ley la señora esposa del fiscal Barbosa no puede contratar por sí misma, o por interpuesta persona, ningún tipo de asistencia, representación o asesoría a una entidad que hubiera estado sujeta a su control como funcionaria. Así está establecido en el Código Disciplinario Único.
El tema no es solo disciplinario también tiene carácter penal. La violación del régimen legal de inhabilidades e incompatibilidades establece una pena mínima de 4 años de prisión y una máxima de 12.
Doña Walfa Téllez como exfuncionaria sin fuero especial debe ser investigada por la Fiscalía. Su esposo, el señor fiscal Francisco Barbosa —que recibió hace dos semanas la denuncia contra ella—ha permanecido en silencio hasta ahora, pero legalmente está obligado a hacer público su impedimento y a pedirle a la Corte Suprema de Justicia que designe un fiscal general ad hoc para que conozca el proceso.

Es una situación inédita. Imagínense lo que pasaría si cualquier subalterno administrativo del fiscal Barbosa, por decir algo la vicefiscal Martha Mancera, decidiera archivar la actuación contra la esposa de su jefe o asignarla a un fiscal como Gabriel Ramón Jaimes ¿Tendrían los colombianos garantías sobre la imparcialidad del proceso?
La única garantía posible es que el caso sea adelantado por un fiscal independiente que no esté sometido a la autoridad del esposo de la indiciada.
