La reforma tributaria, una de las grandes apuestas de Gustavo Fransisco Petro Hurrego, nuevo presidente de Colombia, que generará cambios en la tributación tanto de personas naturales como jurídicas.
Obtener ingresos para impulsar iniciativas de la nueva administración, el objetivo de la reforma.
“Con esta reforma se esperan recaudar COP $25 billones en 2023. Si bien en el pasado se habló de cifras más altas, el proyecto finalmente presentado menciona que el mayor recaudo podría llegar a COP $50 billones a mediano plazo, impulsado por la gestión y la lucha contra la evasión por parte de la DIAN”, señaló Luis Orlando Sánchez, Socio Impuestos Internacionales y Transacciones, EY Colombia.

De acuerdo con lo anterior, estos son algunos de los puntos clave sobre la reforma tributaria:
1. Personas naturales:
Incrementos en la tributación:
Habría incrementos para quienes tengan ingresos superiores a COP $10 millones mensuales. Esto se lograría, por ejemplo, reduciendo el límite a las rentas exentas y deducciones aplicables a la cédula general que sería de COP $46 millones anuales (1.210 UVTs), hoy es de COP $191 millones anuales.
Pensionados:
Pagarían impuesto las personas que reciban pensiones superiores a COP $10 millones mensuales.
Impuesto al patrimonio:
Este impuesto se establecería de manera permanente sobre patrimonios superiores a COP $3.000 millones.

2. Ganancias ocasionales y dividendos:
Ganancias ocasionales:
Las ganancias ocasionales (hoy sujetas por lo general al 10%), serían gravadas bajo la tarifa progresiva en el caso de las personas naturales residentes (hasta 39%). Para las personas naturales no residentes y las sociedades (tanto residentes como no residentes), la tarifa se incrementaría al 30%. Esto aplica para la venta de activos fijos poseídos por 2 años o más, herencias y donaciones, entre otros.
Impuesto a los dividendos:
Los dividendos (hoy sujetos al 10%) estarían gravados para las personas naturales residentes bajo las tarifas progresivas generales (que pueden llegar hasta el 39%), y para los no residentes (tanto personas naturales como sociedades) aplicaría una retención del 20%.

3. Personas jurídicas:
Tarifas aplicables:
Se eliminarían varias tarifas preferenciales, entre estas, las aplicables a ciertos hoteles, parques temáticos, proyectos de ecoturismo o agroturismo; a rendimientos generados por la reserva de estabilización de los fondos de pensiones y cesantías, y al servicio de transporte marítimo internacional.
La sobretasa para instituciones financieras del 3% sería permanente (actualmente se encuentra prevista hasta 2025). Esta genera una tarifa total del 38%, al sumarla a la tarifa general del 35%.
Zonas francas:
De manera general, para mantener la tarifa del 20% tendrán que obtener un plan de internacionalización, buscando ciertos montos de exportaciones. Las zonas francas unipersonales estarían gravadas con la tarifa general (35%).

Límite global a beneficios:
El valor total de ciertos ingresos no constitutivos de renta, deducciones especiales, rentas exentas y descuentos tributarios no podría exceder del 3% anual de la renta líquida ordinaria del contribuyente, antes de los ítems sujetos a la limitación.
Deducciones:
Se elimina la posibilidad de tomar como descuento el 50% del impuesto de industria y comercio (con la reforma solo sería deducible). También se establece que las regalías pagadas al Estado por la explotación de recursos no renovables no serán deducibles, así como tampoco serían deducibles los pagos por afiliaciones a clubes y otros pagos, como apoyos a los empleados para vivienda.

Economía Digital:
Se buscaría gravar como sucursales en Colombia a ciertas entidades no residentes y sin presencia física en el país, pero que tienen cierto nivel relevante de ingresos o de clientes en Colombia, o usan un website con dominio colombiano (.co).
Eliminación de tratamientos especiales:
Varios tratamientos especiales desaparecerían, entre estos: los ingresos no gravados por ciertas ventas de acciones en bolsa y ciertas capitalizaciones; algunos costos y gastos presuntos relacionados con cultivos de café; las exenciones de economía naranja, de desarrollo del campo, algunas rentas exentas asociadas a la vivienda de interés social y prioritario, la renta exenta por transporte fluvial, y la renta exenta para plantaciones forestales; el régimen de megainversiones; los beneficios de Zese (incluidos los recientemente aprobados para Buenaventura y Barrancabermeja); los CERT por el incremento de inversiones en hidrocarburos y minería; y ciertos beneficios relacionados con la industria cinematográfica.

En todo caso, se señala que para quienes hayan cumplido con los requisitos de ley se les respetarán los beneficios durante el tiempo que estaban previstos.
Otros impuestos:
Se establecería un nuevo impuesto a las exportaciones de petróleo crudo, carbón y oro que aplicaría cuando dichos productos se exporten por encima de ciertos valores de referencia. La tarifa sería del 10% sobre la proporción del valor de las exportaciones derivada de un precio internacional superior al umbral.
La nueva reforma propone nuevos tributos para las bebidas azucaradas, los alimentos ultra-procesados, y los plásticos de un solo uso para envasar, embalar o empacar bienes. Por otro lado, plantea gravar al carbón térmico y mineral con el impuesto al carbono.

Aspectos adicionales:
La reforma tributaria también busca establecer medidas para combatir la evasión de impuestos, eliminaría los tres días sin IVA y no generaría cambios en la tarifa actual de 0% de la renta presuntiva.
