La corrupción, en la contratación pública, alcanzó niveles diabólicos y se extendió por todo el país. Compromete la eficacia y eficiencia de la inversión pública. Impide la equidad en redistribución del ingreso y el cumplimiento de la función público-social del estado. Anarquiza la institucionalidad. Destruye la ética y la moral públicas.
La contratación pública debe regirse por un estatuto único, de obligatorio cumplimiento para todas las entidades que manejen dineros públicos.
La normatividad contractual vigente, contiene laxitudes, excepciones, imprevisiones y generalidades que facilitan las maniobras de funcionarios corruptos. Con precios unitarios, especificaciones y cantidades de obra. Los hechos lo demuestran. Compárense los precios de Contratación-Alcaldía y los de Empresas Públicas, frente al festín de contratos, de fin de año, con contratistas foráneos. ¿Transparencia?
Las empresas comerciales del Estado pueden eludir el reglamento contractual general vigente. Pueden regirse conforme a estatutos aprobados por una Junta Administradora de bolsillo, del respectivo gerente y del jefe de gobierno.
Bajo esas condiciones, pueden convertirse en caja menor, de jefes de gobierno, regionales y locales y descentralizados.
Hecha la ley hecha la trampa. Mediante convenios interadministrativos, trasladan dineros de la Administración Central regional, local o descentralizada, a la Empresa Comercial Pública correspondiente, para que contrate a dedo o bajo el reglamento interno respectivo. Son prácticas comunes en todo el país, con algunas excepciones.
Colombia, por corrupción y caos en la contratación pública, pierde anualmente decenas de billones, que van a bolsillos particulares, en vez de aplicarse a saldar la deuda social del Estado con la comunidad.
La Ley 1150/2007 fue aprobada para resolver deficiencias de la Ley 80/93. Después de trece años de vigencia, es inocultable el fracaso. La corrupción se catapultó, en los procesos de contratación, precios unitarios, desarrollo y liquidación de contratos.
Las normas legales vigentes sobre contratación pública, junto con la ineficacia de los órganos de control, permiten al ordenador del gasto deshonesto y a sus secuaces practicar maniobras, en elaboración de pliegos de condiciones, sobre participación, evaluación de propuestas, adjudicación y términos contractuales. Así es posible confeccionar pliegos de condiciones a la medida del mejor postor. Las autoridades y la sociedad lo saben, pero dan palos de ciegos. La laxitud e impunidad institucional y la indiferencia social, facilitan el éxito del flagelo. Las veedurías son comodines engañosos, para maquillar la corrupción.
Se requieren especificidades concretas para elaboración de presupuestos. Es inaudito que el contratista de obra, ejecute estudios y diseños, y según sus conveniencias, elabore el correspondiente presupuesto, como ocurre frecuentemente. Son causa de deficiencias en estudios y diseños y del exagerado costo final de las obras. Son causa del desastre con la inversión en infraestructura, concesiones viales, de primera, segunda y tercera y cuarta generación y de los altos costos de peajes.
El Estatuto de la Contratación Pública debe reglamentar la constitución de sociedades contratantes y calidades profesionales de sus socios, la constitución de consorcios y responsabilidades de sus integrantes.
El estatuto de contratación pública debe definir sanciones drásticas por procedimientos delictuosos en contratación. Debe establecer que todo acto de corrupción en contratación pública, obliga investigación por enriquecimiento ilícito y tiene que sancionarse con exclusión definitiva para ejercer cargo público o contratar con el Estado, por sí mismo o en consorcio o persona jurídica. El ordenamiento jurídico debe probarle al delincuente que el delito no paga.
La corrupción en la contratación pública se puede controlar y erradicar, con voluntad y responsabilidad política y social, de gobernantes y sociedad.
