A quién no le ha pasado que se compra unos zapatos y al llegar a casa ya no le gustan. O que a última hora el jefe le niega el permiso y usted se queda con el tiquete comprado y la maleta lista. En situaciones así muchos creen que su única opción es perder la plata. Sin embargo, existe para todos los consumidores el ‘derecho de retracto’, que no es más que el derecho que tiene cualquier ciudadano de arrepentirse o desistir de una compra.
Primero debe tratar de llegar a un arreglo directo con la empresa, proveedor o aerolínea con la que adquirió su producto o servicio y presentar una solicitud verbal, escrita o por mail manifestando su interés de devolver lo que ya pagó. Tiene cinco días para hacerlo después de haber recibido el bien o celebrado el contrato cuando se trata de compras por internet, catálogos, financiación, televisión, ventas puerta a puerta o fuera del establecimiento.
Usted debe devolver el artículo en las mismas condiciones que lo recibió y, dado el caso, pagar por el transporte. A cambio, debe recibir su dinero máximo 30 días después de haber presentado la solicitud.
En cuanto a compra de pasajes aéreos por internet, el término para vuelos nacionales es de ocho días hábiles, y para internacionales, de 15. Eso sí, la solicitud debe presentarse mínimo 48 horas antes el vuelo y usted debe recibir su plata entre cinco y 15 días después de haberla formulado.
¿Y si no?
Si no le responden, usted puede presentar una demanda verbal, escrita o a través de medios electrónicos ante la Superintendencia de Industria y Comercio, en el link http://serviciosweb.sic.gov.co/servilinea/ServiLinea/DemandasProteccion/. Dicha entidad investigará, y si le da la razón, impondrá multas y ordenará la devolución del dinero. Este es un trámite gratuito y para el que no se necesita abogado.
Ojo: usted podrá retractarse de una compra sin dar explicaciones y solo debe devolver el producto en perfecto estado. Si está inconforme respecto a lo que adquirió, puede presentar su queja o reclamo ante esta misma entidad a través de http://serviciosweb.sic.gov.co/servilinea/formQRSF/control/qrsf.php.
Y si el conflicto es con aerolíneas hay que recurrir a la Aeronáutica Civil por medio del link www.aerocivil.gov.co/Aerocivil/QuejasReclamos. Esta autoridad investigará e impondrá multas a las empresas en caso de hallarlas responsables. Aunque solo sanciona, no ordena reparación de perjuicios ni devolución de dineros.
El derecho de retracto se exceptúa en los siguientes casos:
- Contratos de prestación de servicios que hayan iniciado con el visto bueno del consumidor.
- Contratos de suministro de bienes o servicios en los que el precio esté sujeto a cambios por las variaciones del mercado financiero que el productor no pueda controlar.
- Contratos de suministro de bienes confeccionados conforme a las especificaciones del consumidor o personalizados.
- Contratos de suministro de bienes que por su naturaleza no puedan ser devueltos o puedan deteriorarse con rapidez.
- Contratos de servicios de apuestas y loterías.
- Contratos de adquisición de bienes perecederos o que puedan dañarse rápidamente.
- Contratos de adquisición de bienes de uso personal.
Para tener en cuenta:
- Las aerolíneas pueden retener hasta el 5% del valor del tiquete. Y cuando se trate de tarifas promocionales, la retención puede ser del 15%.
- Las cláusulas de los contratos que limiten el derecho al retracto o que manifiesten que no aplica, serán ilegales.
- El derecho de retracto aplica para los bienes o servicios adquiridos mediante financiación, ventas por Internet, televisión o catálogos, ventas puerta a puerta o por fuera del establecimiento de comercio.
- Los productos que usted compre en un establecimiento de comercio seguirán el trámite de una devolución.

Ahora por inconvenientrs q se tuvieron en la ida de tres pasajeros…nos informan q se pierden esos tiquetes de regreso bogota neiva..y los demas solo nos da los tiquetes neiva bogota para utilizarlos durante los sgtes seis meses…solicitamos q nos devolvieran los tiquetes en dinero…y la respuesta de la agencia fue q no porq avianca no lo autoriza…esto es posible? No nos pueden hacer la devolucion del dinero?
En diciembre del 2013, viaje a Santa Marta con Viva Colombia. Por el fallecimiento de mi padre, debí regresarme al día siguiente de haber llegado. Esta empresa no me hizo ninguna devolución del dinero del tiquete de vuelta, y tampoco me ubicaron en otro vuelo argumentando que no tenían disponibilidad de cupos. Realmente es triste que no haya una reglamentación que valide los derechos del consumidor, y cosas como estas pasen.

Con mi esposo adquirimos una membresia con Effecto Estrategia Internacional, decidimos retractarnos, lo hicimos dentro del termino de ley, nos querian descontar el 5% del retracto, el 8% del uso de tarjeta de credito y $500.000. por una cuota unica de inscripcion. Luego de vario tiempo y de mucha insistencia aceptaron que el 8% lo asumian ellos, pero la CUI de $500.000. No. Decidimos denunciar ante la SIC y despues de 3 años logramos conciliar y los obligan a devolver el dinero. Doy fe que denunciar paga. Hagamos uso de los canales existentes para proteger nuestros derechos.
