Parecerá extraño e incomprensible al desprevenido lector, el epígrafe de esta columna, que significa en lenguaje sencillo, que el principio de laicidad es el que hoy tiene el Estado colombiano, que es un Estado laico como consecuencia de la vigencia de la Constitución de libertades de 1991, contrario al Estado confesional que rigió a este país consagrado secularmente a vírgenes y santos desde hace 200 años por herencia de los conquistadores españoles y la religión católica; que es exactamente el principio que vulneró de manera patente el subpresidente Duque, afectando la libertad de religión y cultos, como atinadamente lo sostuvo la Sala laboral del Tribunal Superior de Cali, ordenándole suprimir un trino que celebraba los 101 años de reconocimiento de la Virgen de Chiquinquirá como patrona de los colombianos, por considerarlo ofensivo para aquellos que no se sienten identificados con el credo católico.

Y es que Duque sabedor de la existencia de nuestro Estado laico y de lo que representa en materia de libertades incluyendo la de cultos consagradas expresamente en el artículo 19 de la Carta con entidad de derecho fundamental, pero nostálgico del conveniente estado confesional para el sometimiento y manipulación de un electorado mayoritariamente católico, así se malgobierne, se le ocurrió a ciencia y paciencia de la vulneración del artículo superior, invocar una celebración religioso católica de hace más de un siglo como presidente de Colombia –lo cual reiteró en su trino- advirtiendo que respetaba las libertades religiosas que estaba ofendiendo en clara manifestación de su fe; que por supuesto es exótica en vigencia de nuestro Estado laico.

Que Duque haya dicho en su trino “que todos los días en profunda oración le doy gracias y le pido por nuestro país”, es una manifestación personal religiosa respetable como cualquiera otra, que no debió expresar públicamente como presidente si verdaderamente quería respetar la libertad religiosa, y lo que es todavía más relevante, la separación entre la religión y el Estado laico que consagra nuestra Constitución Política, dando entender como primera autoridad que se supone que es, en forma tergiversada, que la única religión que reconoce es la católica.

Por eso no cabe como estrategia para atacar el acertado fallo de marras, que este lo que hace es cuestionar las convicciones personales de Duque en materia religiosa, pues está claro que no lo está haciendo como tal, sino como presidente de los colombianos que está obligado a respetar la Constitución dando ejemplo de tolerancia con la libertad religiosa y de cultos, no casándose con una determinada religión por mayoritaria que sea, dado que, precisamente el Estado constitucional lo que hace es  proteger las minorías del avasallamiento de las mayorías, por lo que ha de quedar claro que los que creen cualquiera sea su credo religioso, y los que no creemos estamos protegidos por la Constitución, no estando permitido que ningún funcionario público en ejercicio de sus funciones haga manifestación pública de su creencia religiosa por ser ofensivo a la libertad de religión y cultos, que es lo que no se quiere entender en esta país nostálgico del intolerante estado confesional.
