La revocatoria del mandato en un mecanismo de participación ciudadana, creado por el artículo 103 de la Constitución política de Colombia y reglamentado por las leyes 131 y 134 de 1994, la ley 741 de 2002 y la Ley 1757 de 2015, que consiste en que un alcalde o un gobernador que incumpla con el programa de gobierno que propuso a la ciudadanía al momento de inscribir su candidatura, o cuyo gobierno sufra de insatisfacción popular, puede ser removido del cargo por voluntad popular.
Según el Consejo Nacional Electoral y la Registraduría Nacional del Estado Civil, se han recibido hasta el momento en estas dos instituciones, 28 solicitudes de revocatoria, y para el próximo 22 de enero esta programada la primera audiencia pública, con el fin de escuchar a los promotores de la misma y por supuesto al alcalde encartado. Desde que entraron en vigor las normas que regulan esta materia, nunca se había llevado a un alcalde a una audiencia de este tipo, que por lo visto no será la única, pues el próximo lunes 25 de enero, están programadas las de Bogotá y Medellín.
De acuerdo con cifras publicadas por El Tiempo, desde el año 1996 han sido solicitadas 109 revocatorias, de las cuales solo una ha concluido con la revocatoria de un alcalde, el de Tasco Boyacá, en el año 2018. En mi opinión, factores como la falta de cultura e interés en la política del país, el desconocimiento de la figura por parte de la ciudadanía, la falta de capacitación de los funcionarios de la organización electoral en esta materia, así como la corrupción (que posibilita acuerdos y dilaciones en los procesos), son factores determinantes a la hora de analizar los bajos niveles de efectividad que el mecanismo de revocatoria ha tenido en el país.
Además de lo anterior, pienso que si queremos “afinar” el mecanismo de revocatoria para que cumpla con su espíritu, debe llevarse a cabo una reducción de los trámites burocráticos, se debe brindar financiación a los movimientos pro revocatoria. Pero ojo, movimientos fundados por causas objetivas, no con miras a ser un palo en la rueda de los gobernantes de turno, o una forma de tomar venganza por parte de los partidos que fueron derrotados en las urnas. Mientras no se le realicen los ajustes a las normas que regulan la materia, el mecanismo de revocatoria seguirá siendo un saludo a la bandera.
