Árbitros internacionales avalan los derechos antidumping de Colombia a la importación de papas congeladas desde Bélgica, Países Bajos y Alemania, que están vigentes desde noviembre del 2018.
El panel de árbitros de la Organización Mundial del Comercio -OMC-, que estudió la apelación presentada por Colombia en octubre pasado en el proceso que se sigue por la imposición de derechos antidumping a la importación de papas congeladas, le dio la razón a la agroindustria colombiana en puntos clave.

La decisión arbitral dada a conocer esta semana establece que Colombia tenía la razón al iniciar el proceso de investigación que terminó en la imposición de derechos antidumping sobre las papas fritas congeladas procedentes de Bélgica, los Países Bajos y Alemania.
Los árbitros también le dieron la razón a Colombia en el sentido que el Acuerdo Anti-Dumping de la OMC permite que se tomen en cuenta las interpretaciones jurídicas de las autoridades que adelantan las investigaciones, antes de emitir la interpretación preferida de los tribunales.
Con esta decisión arbitral se inclina la balanza a favor de Colombia frente a los resultados obtenidos en este pleito que se adelanta ante la OMC.

De esta manera, y tomando en cuenta el informe final del Grupo Especial de la OMC conocido en octubre pasado y sumado a esta decisión arbitral, Colombia deberá rectificar algunos aspectos técnicos de las decisiones adoptadas y que derivaron en la imposición de los derechos antidumping.
Entre ellos, el uso de la base de datos DIAN para calcular los márgenes de dumping, el trato confidencial de cierta información presentada durante la investigación y aspectos técnicos del cálculo de los márgenes de dumping.
El ministro de Comercio, Industria y Turismo, Germán Umaña Mendoza, manifestó su complacencia por la decisión y al mismo tiempo dijo que Colombia es respetuosa del mecanismo de solución de controversias de la OMC, por lo que se adelantarán las gestiones pertinentes para implementar las consideraciones de los árbitros en un periodo razonable, atendiendo a los procesos propios de la legislación interna.

Durante este periodo de tiempo razonable, la medida seguirá vigente. Según las normas de la OMC, toda modificación de la medida tendrá tan solo efecto prospectivo, incluyendo una eventual reducción en los derechos antidumping.
De otra parte, para el análisis de esta apelación se estrenó el acuerdo de arbitraje de apelación provisional multipartidista (conocido como MPIA), que reemplaza, de manera provisional, al Órgano de Apelación de la OMC.
El MPIA es una estrategia exitosa de Colombia y otros países para mantener en función el sistema de solución de diferencias de la OMC, hasta que se resuelva el tema del nombramiento de los Miembros del Órgano de Apelación.
