Con la decisión de la Corte Constitucional de declarar inexequible, que es lo mismo que decir inconstitucional, el Decreto 1979 del 6 de octubre de 2015, que apaga literalmente la hidroeléctrica de El Quimbo,- que equivale a retirar 400 megavatios del sistema de generación de energía estimado en un 5% de la demanda nacional-, ha quedado patente no solo la incongruencia del decreto, sino la de este desastrado país, que ahora por no haberse acatado un fallo judicial -que debió acatarse así fuera equivocado como regla de oro de un estado democrático-, nada menos que por el mismo presidente de la República, debe afrontar las consecuencias de su incongruencia en materia de generación de energía en pleno rigor del fenómeno de “El Niño”. Mejor dicho, tras de cotudos con paperas.
Y es que hay que explicar qué significa incongruencia interna y externa del decreto de marras como lo ha dicho la Corte Constitucional para declarar su inconstitucionalidad: que simplemente no existió coherencia alguna entre sus motivaciones y su parte resolutiva, lo cual constituye un auténtico esperpento jurídico, que es lo mismo que decir para que lo entiendan los legos, expedido miando fuera del tiesto, y ello resulta inadmisible en el equipo jurídico del gobierno nacional, que ahora tendrá que responder, incluido el presidente Santos por el descomunal despropósito juris, por lo menos por prevaricato y fraude a resolución judicial.
Ahí estamos pintados dirá el escritor Fernando Vallejo. Porque con el desaguisado jurídico, no solo no se podrá cumplir con la medida cautelar del Tribunal Administrativo del Huila en beneficio de la salubridad y el medio ambiente por el no retiro de la biomasa del embalse cuando ya está prácticamente lleno y causado el enorme daño, sino que ahora con el apagón del mismo para generar energía en medio de la atroz sequía que se anuncia hasta el mes de junio del año entrante, no vamos a poder generar la energía para evitar un racionamiento que nos acabe de sumir en la incongruencia y la catástrofe. Eso pasa, cuándo, como lo expresara en el Concejo de Neiva para referirme al caso de Mercaneiva, se toman decisiones de contenido jurídico no pensando con el juicio de la racionalidad, sino con el prejuicio y la irracionalidad de las vísceras y la conveniencia de ocasión cuando se supone que estamos regidos por un Estado de derecho.
Pero así somos los colombianos, viscerales y poco racionales, y por eso estamos como estamos. ¿Cómo se irá a resolver el entuerto?, no lo sabemos: de pronto habrá que desocupar el embalse para cumplir con la atinada medida cautelar del tribunal y someternos a un racionamiento de energía por no poder generarla en medio de la sequía. Seguramente no va a pasar nada con las investigaciones que se han ordenado por parte de los tribunales, como no ha pasado nada con los grandes crímenes que se cometen en Colombia, y el asunto será resuelto con otro decreto para conjurar la emergencia ordenando que se mate media vaca, como lo ordenó el malhadado decreto que la Corte Constitucional declaró inexequible por ser doblemente incongruente.
