El fiscal general Néstor Humberto Martínez (NHM) ha dirigido una carta mañosa al mañoso presidente del Senado Ernesto Macías con el fin de actuar como tándem en armónica perfidia, que tiene como objetivo tratar de ponerle un petardo al Proceso de Paz por temor a la verdad, a puertas de resolverse sobre las objeciones a la Ley Estatutaria de la JEP, -que en verdad como se ha dicho son a la sentencia de la Corte Constitucional que ya dio su veredicto de constitucionalidad que debe ser inexorablemente acatado- para que, de lograr su mañoso propósito y el Senado caiga en el garlito de aceptar las objeciones, impedir que la JEP pueda funcionar a cabalidad.
Y digo carta mañosa en toda la acepción de la palabra: de accionar con astucia y engaño para conseguir una cosa, porque NHM insiste en sostener la falacia que ya sostuvo ante el Congreso, de que uno de los artículos de la referida ley estatutaria abre la puerta para que narcotraficantes se beneficien con la suspensión de la extradición, porque afirma que no se extraditará a quienes estén ofreciendo verdad –que por supuesto no es cierto-, lo que afectaría no solo los compromisos internacionales de Colombia en materia de cooperación judicial, “sino que, a su amparo, surgiría la posibilidad de que cualquier delincuente pueda reclamar la aplicación de la prerrogativa so pretexto de ofrecer “su verdad” a la justicia transicional”.
Lo dicho. Nada más falaz y marrullero, porque, lo primero: NHM pretende en forma desviada y absurda con la aceptación de las objeciones por parte del Senado que se reforme la Constitución por intermedio de una ley subalterna de procedimiento de la Jurisdicción Especial para la Paz; y lo segundo, que es un auténtico embuste que la JEP vaya a impedir la extradición de narcotraficantes de ser rechazadas las objeciones, porque de acuerdo a lo que ya quedó incorporado a la Constitución y a lo que dejó sentado la Corte Constitucional con su veredicto de constitucionalidad, la JEP no se puede ocupar de juzgar narcotraficantes, por lo que en ninguna circunstancia pueden acudir a la justicia transicional para ofrecer verdad y librarse de la extradición.
Y además, como lo sostuviera lúcidamente el destacado y creíble jurista Yesid Reyes Alvarado por no estar sesgado en sus opiniones jurídicas, las “otras personas” a las que se refiere NHM que identifica ladinamente de entrada como narcotraficantes: “solo pueden ser los miembros de las Fuerzas Armadas, así como los agentes del Estado y los terceros que voluntariamente acudan a la JEP, porque son los únicos “otros” sobre los que esa jurisdicción tiene competencia”, y nunca los narcotraficantes.
De ahí que lo afirmado por el presidente Duque sirviendo de caja de resonancia del fiscal, de que se trata de un King Kong y no de un mico lo que se ha advertido en la ley estatutaria, es tan mañoso como lo que se afirma en la mañosa carta dirigida al mañoso presidente del Senado. Y esta corporación legislativa si respeta el Estado de derecho y la Constitución no puede actuar mañosamente ante tamaña carga mañosa.
