La solicitud que han hecho convictos por crímenes atroces como Alberto Santofimio Botero y Miguel Maza Márquez condenados por la Corte Suprema de Justicia por el magnicidio de Luis Carlos Galán, para ser cobijados por la Jurisdicción Especial para la Paz, no es más que un torcido ejercicio para tratar de obtener libertad inmediata para librarse de lo que les resta de las condenas de 24 y 30 años de cárcel respectivamente, que es lo mismo que impunidad , pues es claro que nada tiene que ver el conflicto armado con semejante crimen, y por lo tanto las sentencias condenatorias no pueden ser revisadas en manera alguna por la justicia transicional, como atinadamente la Procuraduría se lo hizo saber a la Sala de Definición de Situaciones Jurídicas de ese Tribunal.
Y es que todos los colombianos sabemos por ser de dominio público y cosa juzgada, que el asesinato del caudillo liberal no tiene relación alguna con la justicia que debe dispensar la JEP, porque fue producto de una alianza infame de narco políticos para tratar de beneficiarse del horrendo crimen ante la inminencia del triunfo de Galán -sabedores de que desataría una lucha implacable contra la corrupción de la política aliada con el paramilitarismo y el narcotráfico-, imponiendo como adehala un clima de terror e incertidumbre como lo ha dicho también la Procuraduría, para pretender continuar con ese reinado siniestro que tanto daño le hizo a la sociedad colombiana.
Por eso resulta muy oportuno el pronunciamiento de la Sala Penal de la Corte Suprema de Justicia, precisando que las condenas contra terceros civiles que ya están ejecutoriadas solo pueden ser revisadas por sus propios magistrados, dejando absolutamente claro que la única excepción son los fallos contra los miembros de la Fuerza Pública y excombatientes de las Farc , negando también el paso a la JEP de un proceso del ex senador Álvaro García Romero condenado a 40 años por la espantosa masacre ocurrida en el año 2000 en el corregimiento de Macayepo- Bolívar, que dejó 66 muertos y 246 familias desplazadas, quien buscaba como Santofimio y Maza su libertad inmediata.
No le quedará más alternativa a la JEP que atender la petición de la Procuraduría para impedir que estos criminales resulten cobijados por su jurisdicción y recobren una libertad que no se merecen, pues deberían podrirse en una cárcel sin que fuera suficiente castigo para la magnitud de los crímenes que cometieron; lo mismo que devolver inmediatamente como se lo ha solicitado la Corte el expediente de Maza Márquez, pues faltaría más que nuestra precaria justicia se cubriera de mayor ignominia haciéndole concesiones a los más despreciables delincuentes fomentando la impunidad que ha sido el denominador común para los grandes crímenes que se han cometido a lo largo de nuestra sangrienta historia. A ese paso de querer relacionar todos los crímenes con el conflicto armado buscando liberación los criminales sometiéndose a la JEP, no sería raro que los abogados de Garavito y Uribe Noguera el asesino de la niña Yuliana Samboní, hicieran solicitud de libertad inmediata en este paraíso de la impunidad.
