El Consejo de Estado, amparó la autonomía que constitucionalmente tienen las Universidades Públicas en Colombia y dejó sin piso las pretensiones de la Ministra de Educación, Yina Parody, de anular la elección del actual rector de la UNAD, Jaime Alberto Leal Afanador, por supuestas irregularidades en el proceso cumplido a comienzos del 2015.
Según el fallo proferido el 26 de noviembre, “las Universidades son autónomas en el manejo de su presupuesto y en la elección de sus directivas”, por lo que cualquier intervención de terceros “atenta contra el principio de autonomía de la institución y las posibilidades de ofrecer una mejor educación”. De esta manera el Rector podrá seguir al frente de esa institución educativa que desde hace más de 30 años ofrece educación profesional a los colombianos mediante la modalidad a distancia y virtual, siendo la más importante de su género en América Latina y una de las mejores en el mundo.
El director de la UNAD en la Zona Sur, Jorge Eliecer Cruz Ortiz, dijo que este fallo del Consejo de Estado no solamente demuestra que los procesos y procedimientos en esa universidad se hacen de manera transparente, sino que le devuelve la autonomía a las universidades públicas, puesta en peligro por las pretensiones intervencionistas de la actual ministra de Educación Nacional.
