La inseguridad ciudadana, en toda Colombia, alcanzó niveles de cataclismo social. La inseguridad generada por las guerrillas tradicionales de antaño, ya no es la mayor amenaza.
La delincuencia común y organizada, estimulada y al servicio del narcotráfico y la delincuencia de cuello blanco, sometieron a la nación, a la dictadura del miedo. Y las respuestas y actitud del gobierno y la misma sociedad, ante la magnitud del peligro, no corresponden a lo que se requiere para conjurar la apocalíptica amenaza nacional.
Parece que el gobierno y la institucionalidad, no entienden la gravedad del problema y prefieren salidas folclóricas, como las que propone el Ministro de Justicia. Ese Ministro esta evadido de la realidad nacional. No sabe de donde es vecino. Desconoce o no sabe interpretar las causas que la generan.

Las causas medulares están en la inequidad socioeconómica, el desempleo y sub empleo, la laxitud y complicidad institucional, la irresponsabilidad e inmoralidad del poder público y de la misma sociedad, factores que determinan el precario desarrollo integral nacional y el excluyente modelo económico-político. La impresión es que todos están al servicio de la corrupción, la impunidad y la mediocridad burocrática.
Organizaciones internacionales por la defensa de los derechos civiles y transparencia de la justicia, reiteradamente señalan el crecimiento de la criminalidad y la impunidad en Colombia. Precisan que la impunidad supera el 97%. Estadísticas verificables, ubican a Colombia entre las cuatro naciones con mayor criminalidad, inseguridad ciudadana e inequidad socioeconómica, en el planeta. Esto ocurre mientras sostiene el gasto militar más alto del hemisferio, proporcional al PIB (mayor al 6% del PIB).

Colombia gasta más de $120.000 millones diarios en su aparato militar, policial e inteligencia, sin incluir inversiones en equipamiento y crecimiento de pie de fuerza, pago de recompensas a delatores y hasta a aliados criminales, en no pocos casos. ¿Es el costo de la garantizada inseguridad?
Las acciones y decisiones del gobierno no son coherentes con la magnitud de los desafíos de la criminalidad
Hay más de 1.5 millones de armas de fuego legalizadas, en manos de civiles. Pero por cada arma con salvoconducto hay 6 ilegales. Promedio de una por cada 5 habitantes, sin control efectivo, por parte del gobierno. Los gobiernos son los responsables de la seguridad ciudadana y ¿en Colombia de la inseguridad?
Por mantener el modelo socio-económico y la estructura de poder que lo sustenta, Colombia se ubica entre las tres naciones de mayor iniquidad socioeconómica del mundo y mayores registros de criminalidad e impunidad.

¿Qué porcentaje de la población, es consciente o no conoce las cifras y los hechos, relacionados, con la inseguridad e irresponsabilidad de los gobiernos? Las mayorías desconocen las casusas reales y los responsables.
El desafío, de cambiar la inseguridad por Seguridad Total, es cósmico, en términos prácticos y es inalcanzable, si no erradican las causas que generan la inseguridad.
No se resuelve con el formalismo recurrente de Consejos de Seguridad, lamentos plañideros ante las víctimas, bendiciones de humo, cadenas de oración y verborrea engañosa.
Requiere decisiones concretas e inmediatas, normas legales y programas permanentes de desarrollo socioeconómico y control institucional, en todos los niveles de la vida nacional.

Se necesita, quién sea capaz de hacer cumplir la ley e impulsar el desarrollo económico. Se requiere de quién crea en la necesidad mejorar la calidad de la educación, la salud, los servicios públicos, erradicar la corrupción, la mediocridad, la pobreza, etc.
Para lograr esos objetivos, es imprescindible sustituir importaciones por producción nacional y redefinir y reestructurar el modelo económico-político. Reconstruir la ética y la moral pública y social, en todo tipo de actividad nacional.
Tienen que extirparse para siempre la impunidad y la corrupción en todas las instancias de poder público. Abolir privilegios tributarios, rentísticos, burocráticos, penitenciarios y judiciales, hoy practicados a favor de particulares específicos y burócratas.

No es posible alcanzar esos objetivos solo con la aprobación o modificación de leyes o decretos.
La corrupción penetró toda la contratación pública, en toda la geografía nacional.
La estructuración de un Nuevo Estatuto para la Contratación Pública, es un imperativo moral y social. Imposible lograrlo vía Congreso. La vía rápida es mediante facultades extraordinarias concedidas por el Congreso. El actual presidente debió solicitarlas el 7 de agosto de 2022.
La estructuración y definición de ese Nuevo Estatuto Integral para la contratación pública, debe hacerla una comisión especial, integrada por personas de amplio conocimiento y experiencia en análisis de costos, especificaciones técnicas, programación de inversión y desarrollo de proyectos, entre otros.

Sería una insensatez imperdonable y condenable, confiarla solamente a abogados, economistas, administradores, filósofos, poetas, artistas, lagartos, politiqueros y habituales burócratas paracaidistas. Es un asunto específicamente técnico y ético. Y por esa condición, el Congreso, debe conceder facultades extraordinarias. Ese Nuevo Estatuto, debería estar ya aprobado.
Para el gobierno actual, la inseguridad ciudadana, la criminalidad, la corrupción y la impunidad, debieron ser objeto de las primeras decisiones de gobierno. Son asuntos y problemáticas de interés nacional.
La inseguridad ciudadana y la criminalidad, deben atacarse removiendo las causas primarias que las estimulan, generan y sustentas
El universo de tales causas no puede revertirse y extirparse solo con aumento de pie de fuerza, toques de queda y misas diaconadas.
Requieren estructurar, aprobar y aplicar políticas de estado específicas para reducir efectivamente el desempleo y la informalidad. Es imprescindible impulsar la producción nacional, para generar puestos de trabajo, mejorar salarios básicos y reducir a mínimos la informalidad.

Esas decisiones deben estar acompañadas de la Declaración de Emergencia Nacional por Inseguridad Ciudadana, desde hoy, mediante la cual prohíban totalmente el porte de todo tipo de armas, de fuego y blancas, en todo el país. Ordene realizar juicios sumarios al que incumpla la prohibición, con sanción de detención intramural inconmutable, mínimo por tres años, si no tiene antecedentes o más según la gravedad de los antecedentes. Es una estupidez pretender resolver la inseguridad con prohibir el parrillero o con el torpe embeleco de la Justicia Restaurativa. a la hora que todos duermen.
Todo ciudadano debe entender y encontrar la razón de que la solución de la problemática de la inseguridad ciudadana y la criminalidad nacional, solo es posible resolverla si se resuelve, el desempleo, la informalidad, los bajos salarios, la impunidad, la corrupción, la politiquería, el clientelismo, la impunidad judicial y la mediocridad e inmoralidad de quienes ejercen poder público. Es inaplazable doblar la capacidad de albergar delincuentes en cárceles, de alta seguridad y redefinir el Código Penal y de Procedimiento penal.

¿Será posible que el actual gobierno entienda y decida actuar en consecuencia?
Pero debe estar dispuesto a recurrir al Constituyente Primario, para lograr las reformas constitucionales requeridas para institucionalizar las reformas, que el Congreso no apruebe o desvirtúe su contenido.
Todo individuo que ataque a cualquier ciudadano, de cualquier manera, o pretexto debe ser privado de su libertad, en cualquier lugar del país, hasta que demuestre su inocencia o pague condena por su ataque criminal. Y los funcionarios judiciales que desacaten el ordenamiento legal, deben ser excluidos, indefinidamente del servicio público y de la contratación con el sector público. El balón lo tiene el gobierno.
