TOMADO: El tiempo
En las próximas horas el director de la Unidad para la Atención y Reparación de las Víctimas, Alan Jara, dejaría su cargo a disposición del presidente Juan Manuel Santos. Este cargo es ocupado por Jara desde el año pasado.
La renuncia de Jara se daría en medio de la investigación que lleva la Fiscalía por el fallido proyecto de la Refinería del Meta y un contrato con Llanopetrol, la empresa de petróleos de este departamento, que se convirtió en el impulso político bandera de Jara cuando fue gobernador.
Las irregularidades se derivan de un convenio interadministrativo que se elaboró con el objetivo de sacar adelante un estudio y el diseño para la implementación de la Refinería del departamento del Meta.
Por este contrato, firmado el 24 de octubre del 2013, tres de las personas claves en el equipo del hoy saliente director de la Unidad para las Víctimas, fueron enviadas a la cárcel el pasado viernes, en cumplimiento de una medida de aseguramiento.
Los detenidos son Luz Stella Casasfranco Vanegas, mano derecha de Jara desde hace más de dos décadas. Ella trabajó como jefa de Asuntos Contractuales en la gobernación 2012-2015 y ahora estaba al frente de la Oficina Jurídica en la Unidad de Víctimas.
También fueron capturados Hernando Martínez Aguilera, secretario de Planeación en la administración de Jara y a quien él nombró como Jefe de la Unidad de Víctimas en el Meta; Jairo Iván Frías Carreño, exsecretario de Hacienda de Jara y hoy rector de la Universidad del Llano; y el exgerente de la Empresa de Petróleos del Llano (Llanopetrol) Ricardo Rodríguez Henao.
Cuestionamientos de la Fiscalía
Entre las irregularidades encontradas en el convenio para los estudios previos para la construcción de la Refinería, la Fiscalía aseguró que se desviaron recursos cercanos a los 18.265 millones de pesos, el periodo en el que Jara fue gobernador, es decir, entre el 2012 y el 2015.
Los dineros fueron girados a la entidad con la que la administración firmó el convenio, la Empresa de Petróleos del Llano (Llanopetrol). Sin embargo, dijo la Fiscalía “los proyectos no fueron concluidos ni liquidados”.
La detallada descripción la hizo la delegada fiscal durante la audiencia de imputación de cargos a los cuatro detenidos, involucrados en estos hechos, quienes al final de los señalamientos se declararon inocentes.
La Fiscalía les imputó los delitos de peculado por apropiación en favor de terceros, en concurso con interés indebido en la celebración de contratos sin el cumplimiento de los requisitos legales.
Estas personas, señaló la Fiscalía, “se interesaron de manera indebida en la presentación, viabilidad y registro de los proyectos 452 y 256 en el año 2012″.
Estos proyectos se tramitaron sin el lleno de los requisitos legales y violando los principios de planeación, responsabilidad y transparencia en la contratación estatal, así como lo establecido en la Constitución los convenios 404 y 490 del 2013. “Todo ello para apropiarse de recursos públicos en favor de terceros. Como resultado del actuar criminal de estas personas al día de hoy no existe una finalización de los respectivos proyectos”, señaló la Fiscalía en la audiencia de imputación contra los cuatro detenidos.
En estos fallidos proyectos se afectaron recursos por 9.220 millones de pesos que corresponden a las regalías y 9.045 de dineros de la Gobernación, que fueron obtenidos a través de un crédito al Banco de Bogotá, “que se transfirió con el objeto de hacer viable el proyecto”.
Una de las irregularidades que encontró la Fiscalía fue que el permiso expedido por el Ministerio de Minas para la realización del proyecto de factibilidad en el año 1999 ya estaban vencidos, porque solo tenían seis meses de viabilidad. Todas estas irregularidades llevaron a la judicialización de la asesora jurídica Casasfranco Vanegas.
