En mi columna de hace 15 días que titulé “Tumbar la JEP”, anticipándome a las pérfidas objeciones que hizo el subpresidente Duque por encargo de su mentor y verdadero gobernante a la ley estatutaria de la JEP para impedir su cabal funcionamiento, expresaba que si se llegaban a concretar como en efecto ocurrió, no sería más que un acto de bellaquería política para tratar de tumbar la JEP y el proceso de paz con todo lo que ello significaba para el país y su institucionalidad, que quedaba seriamente fracturada por el desconocimiento de nuestro derecho interno y por supuesto del derecho internacional.
Y precisamente así lo reconoció de manera contundente el ex comisionado de Paz Sergio Jaramillo por corresponder a la cruda realidad, de la barbaridad cometida por Duque al atacar con ferocidad la institucionalidad para satisfacer a la cáfila guerrerista de su partido político en declaraciones al diario El Espectador el pasado domingo: “Estamos ante un desacato presidencial de un fallo de la Corte Constitucional, un desconocimiento del tribunal de cierre. Una barbaridad. Ni siquiera Álvaro Uribe de presidente se atrevió a hacer eso. Imagínese: hoy es la JEP y mañana el presidente se brinca cualquier otro fallo de la Corte cuando le parezca “inconveniente” (…)Desde el intento de Uribe de meter el famoso “articulito” para aferrarse al poder no vivimos una crisis institucional tan grave. El Estado de derecho de que tantos nos preciamos, y que creemos que nos diferencia de nuestros vecinos es precisamente eso: un Estado en el que las autoridades, comenzando por el presidente de la República, se someten a la Constitución y a la ley. Acatan los fallos de la Corte Constitucional. Lo contrario es echar por un sifón la institucionalidad, y ya sabemos eso adonde llega”.
Más claro no canta un gallo, para entender la magnitud del estropicio que ha cometido Duque, que no es más que el acto de bellaquería política que me anticipé a denunciar, que para ser exactos, es de las más burda y perversa politiquería que no política contra el Estado de derecho, solo comparable con un acto de tiranía contra nuestra precaria democracia, que cualquiera puede entender después de lo que lapidariamente ha dicho Sergio Jaramillo por corresponder a la realidad jurídica monda y lironda, pues si bien Duque como lo ha reconocido la Corte Constitucional podía objetar la ley estatutaria por inconveniencia, no fue lo que hizo, porque realmente lo que objetó fue la sentencia de la Corte desacatándola palmariamente, cuando esta ya había dado su veredicto de constitucionalidad con mérito de cosa juzgada constitucional con efectos erga omnes, que es ni más ni menos que un golpe artero a la institucionalidad y al Estado de derecho. La barbaridad que ha cometido Duque por encargo de Uribe y su partido político, tendrá que ser enmendada por el Congreso de la República para restablecer el orden jurídico, rechazando las malévolas objeciones si verdaderamente actúa como garante de la democracia, so pena de contribuir al arrasamiento infame de las instituciones y de la misma Carta Política.
