Un presunto daño fiscal de USD$2.879 millones de dólares, equivalentes a $8.5 billones de pesos, determinó finalmente la Actuación Especial que adelantó la Contraloría General de la República sobre la puesta en marcha y ejecución del proyecto de la Refinería de Cartagena, REFICAR.
Esta cifra es igual a:
*6 veces el daño fiscal de SALUDCOOP, el más grande del país hasta ahora, que fue de $1.4 billones de pesos.
*Un poco más de lo que se espera como recaudo adicional con la reforma tributaria en 2017.
*Becar durante dos siglos a los 22 mil estudiantes que actualmente tiene el Programa Ser Pilo Paga.
*0 600 mil viviendas gratis, la mitad del déficit de vivienda nueva.
“Son 36 hallazgos fiscales que totalizan esta escandalosa suma de dinero”, señaló el Contralor General de la República, Edgardo Maya Villazón, al revelar hoy las conclusiones de este informe.
Esta Actuación Especial fue adelantada por la Contraloría Delegada de Minas y Energía, a través de un equipo de alto nivel conformado por 28 experimentados auditores (15 de esta dependencia y 13 de otras Delegadas), siendo la primera vez que una actuación de la Contraloría demanda un número así de grande de funcionarios para adelantar labores de control.
La CGR revisó 177 subcontratos y encontró que de los US$2.879 millones de hallazgos fiscales, unos USD$943 millones (32%) corresponden a posibles irregularidades en contratación.
En cuanto al lucro cesante que se generó, que completa la totalidad del daño fiscal, la Contraloría consideró que hubo falta de planeación por parte de CB&I como experto en la construcción de plantas de refinación, para la elaboración de la ingeniería (diseños), la adquisición de bienes y la construcción.
Tales componentes nunca se alinearon y por el contrario presentaron múltiples irregularidades, cuando se suponía que esta firma reunía las condiciones de idoneidad y experiencia para la ejecución de megaproyectos de esta magnitud.
Esta situación hizo que no ingresaran recursos al patrimonio del Estado en cabeza de REFICAR, por valor de USD$1.936 millones de dólares.
UNA DEUDA QUE PAGAMOS TODOS
La sociedad colombiana, por intermedio de ECOPETROL –garante final del proyecto, está hoy endeudada hasta el 2046, fecha a la que llegan los compromisos financieros.
REFICAR hoy tiene una deuda por USD$1.657 millones con la filial de Ecopetrol denominada Ecopetrol Capital AG, que tiene un patrimonio negativo (el 99% del mismo corresponde a las cuentas por cobrar a REFICAR).
El proyecto tiene hoy un valor presente negativo de USD$9.213 millones, como consecuencia de sus adiciones presupuestales y la destrucción de rentabilidad esperada. El presupuesto inicial era de USD$3,777 millones y el valor ejecutado llega a USD$8,016 millones.
Con las adiciones presupuestales, se modificó una tasa de rentabilidad del proyecto esperada de 16,10% a una de 4,35%, que está por debajo de la deuda del proyecto (5,5%).
Por la estructura financiera de REFICAR, sus rentas futuras están pignoradas, Es decir, se hizo la refinería a crédito y hoy se hace un gran esfuerzo para pagar.
La Contraloría analizó también la situación actual de REFICAR y encontró que siguen llegando materiales constructivos y que, al 31 de agosto de 2016, la refinería ha tenido 38 paradas operacionales.
INEFICIENTE GESTIÓN FISCAL
Los casos de gestión fiscal ineficiente detectados en la construcción de la refinería son numerosos y ocupan varias páginas del informe de esta Actuación Especial. Y se encuentran algunas curiosidades, como el pago de llamadas telefónicas y costos de minibar no justificados por USD$7.947 por parte de CB&I, a pesar que dichos ítems se tenían como gastos no reembolsables y por tanto no tenían –dentro del clausulado normativo contractual- soporte alguno para su reconocimiento y pago.
Así mismo, CB&I pagó al subcontratista por alquiler de cada unidad de baño portátil la suma de $880.052 para el año 2011, valor que fue modificado hasta llegar a $640.388 en el año 2015. La Contraloría realizó un sondeo de mercado mediante cotizaciones que cumplen las respectivas condiciones de tiempo, modo y lugar, y encontró que se hizo un pago superior al del mercado por esta contratación, por un valor de $9.597 millones.
También está el pago de servicios de transporte por $724,5 millones que nunca se utilizaron.
Son varios los casos en que se suscribieron contratos y órdenes de compra de adquisiciones de materiales y equipos que resultaron en compras excesivas, comprometiendo recursos públicos en elementos que no se utilizaron y que no serán necesarios para la operación de la refinería. La CGR calcula que los mismos pueden tener un valor de USD$57,7 millones (en el 42,6% que cuenta con avalúo. Del 57.4% restante se desconoce su precio).
En total, se determinaron 3.9 millones de unidades de materiales sobrantes.
Se dio también un incremento injustificado del valor inicialmente pactado para la construcción de los racks de tubería por valor de US$72.7 millones de dólares.
Y en el alquiler de grúas hidráulicas, subcontratado por CB&I, se dio un presunto daño fiscal por valor de $37.855 millones. Se evidenció que para un estimado de utilización de 84 grúas, en la mayoría de los meses solo se contaba con un operario y un supervisor. Es decir, no se podían utilizar todas las grúas disponibles y facturadas.
Otro detrimento patrimonial se dio en la ejecución de los contratos de alquiler y/o compra de andamios. Se detectó un costo de USD$135.1 millones por andamios sin justificación dentro de la obra.
De otro lado, CB&I suscribió 6 subcontratos con el objeto de realizar la preparación y adecuación de la zona para el almacenamiento temporal de equipos importados que llegaban por el puerto, en el sitio denominado Casablanca 1,2, y 3. Esta adecuación –que no estaba contemplado dentro del proyecto- costó $19.255 millones.
