Más allá del debate de corrupción que el senador Robledo realizó ayer en el congreso de la república contra el Minhacienda, Alberto Carrasquilla, estoy de acuerdo, parcialmente, con la afirmación de Rudolf Hommes de que, el problema de fondo “es la precariedad e insostenibilidad de las finanzas de los municipios pequeños y medianos.” Digo que estoy parcialmente de acuerdo, porque el exministro Hommes, oculta que, en buena parte, el problema radica en la reforma constitucional que recortó en una proporción sustancial las transferencias de los ingresos corrientes de la nación, establecida en la constitución del 91 a regiones y municipios. Esa fórmula que era consistente con la nueva arquitectura institucional de transferir a regiones y localidades la responsabilidad de atender las necesidades más apremiantes de la sociedad: salud, educación, servicios públicos, vías, cultura y deporte, etc., fue abortada con la reforma del año 2001, ratificada con el acto legislativo del año 2007, impulsada por Carrasquilla y que, va a ser ratificada, con el proyecto de ley sobre el Sistema General de Participaciones-SGP, presentado por el gobierno Santos en la presente legislatura que el actual gobierno comparte y acompaña.
Ese recorte, dejó minusválidos a departamentos y municipios. Los recursos son inmensamente insuficientes frente a las grandes responsabilidades que se les asignaron a gobernadores y, sobre todo, a los alcaldes. Basta revisar las noticias de los reclamos permanentes de comunidades por el abandono de escuelas, hospitales, puestos de salud, vías, puentes…, que los mandatarios locales no pueden resolver. Las propuestas de reforma del régimen tributario de municipios y regiones de las que habla Hommes, la de 1994 por ejemplo, tienen como eje la actualización del catastro que, es una renta importante pero altamente inflexible una vez se actualiza. Sin olvidar que ese es un rezago histórico del problema de la tierra: su repartición, su tenencia, la legalización de la propiedad y, especialmente su vinculación al sistema económico productivo dificultada por la carencia de servicios y bienes públicos modernos. Pretender con esto, evadir la responsabilidad de la nación de compartir, en proporción adecuada, los ingresos corrientes con municipios y departamentos es mantener el desequilibrio y la minusvalía de los entes territoriales.
Esa degradación de la institucionalidad se ha visto agravada por el régimen político que perpetúa el control de las actuales élites en el poder. La centralización de recursos en cabeza de la nación tiene que ver con tener el control de la repartición de los mismos para incidir de manera perversa en el sistema electoral. Unas elecciones sin “mermelada” no son manejables a la luz de los caciques políticos de los partidos en el poder.
Finalmente, digamos que afecta los resultados administrativos la baja calidad de los gobiernos locales y regionales, no solo inficionados por la corruptela, sino que, nunca se les ha implementado un programa serio de desarrollo institucional en alcaldías y gobernaciones que genere capacitación adecuada y establezca requisitos mínimos para ejercer esos cargos y garantizar la eficacia.
