Un total de 8 Directivos de Bioenergy Zona Franca S.A.S son responsabilizados por La Contraloría General de la República, de un daño patrimonial al Estado por $31.261 millones, considerados pérdida de recursos públicos entregados al proveedor, por concepto de reconocimientos e indemnizaciones y la disposición de toneladas de caña al suelo, que no fueron usadas en la producción de etanol.
La Contraloría imputó culpa grave al Gerente General de Bioenergy Zona Franca S.A.S. y a su Junta Directiva, para la época de los hechos, por la pérdida de los recursos públicos al no hacer efectivas las cláusulas de fuerza mayor y caso fortuito, así como la de revisión por circunstancias imprevistas, pactadas en el Contrato de suministro de caña de azúcar.
Lo anterior por retrasos en el inicio de operaciones de la planta de etanol “El Alcaraván”, en el Meta, que afectaron el componente agrícola de este proyecto, porque no se pudo recibir la caña de azúcar contratada con Riopaila Castilla S.A.
Por lo tanto, La Unidad de Investigaciones Especiales contra la Corrupción de la Contraloría General de la República imputó responsabilidad fiscal, a título de culpa grave, contra 8 directivos en su momento de BIOENERGY ZONA FRANCA S.A.S. firma filial de Ecopetrol actualmente en trámite de liquidación.
Causales
Esto con ocasión de la celebración del Contrato de suministro de caña de azúcar ZF No. 0011-10 de noviembre de 2010, celebrado con la empresa RIOPAILA CASTILLA S.A., para el suministro de 300.000 toneladas de caña al año, por el término de 22 años, el cual iniciaría tres meses después de la puesta en marcha de la planta industrial para la producción de etanol “El Alcaraván”, situada en Puerto López (Meta).
Mediante Contrato ZF No. 050-10 de junio de 2010, con la empresa española ISOLUX INGENIERÍA S.A., se contrató la construcción de esta planta industrial, con un plazo de 22 meses la cual empezaría a funcionar en abril o mayo de 2012; y para el suministro de la caña de azúcar se celebró el contrato antes mencionado.
El 8 de abril de 2014, BIOENERGY ZONA FRANCA S.A.S., terminó el contrato ZF No. 050-10 con ISOLUX y para continuar con la ejecución del proyecto en su componente industrial, suscribió el 18 de julio de 2014 el contrato ZF No. 0010 -14 con el CONSORCIO MENEGUA, con un plazo de 14 meses, que tampoco cumplió, al celebrar 15 otrosíes.
La planta industrial, finalmente inició sus operaciones el 14 de julio de 2017, lo que afectó el componente agrícola, porque no se pudo recibir la caña de azúcar contratada con RIOPAILA CASTILLA S.A.
Tal situación generó un daño patrimonial al Estado por la pérdida de los recursos públicos entregados al proveedor, por concepto de reconocimientos e indemnizaciones que se concedieron a través de la celebración de los otrosíes Nos. 1 y 2, en cuantía de $24.223.527.390, y la disposición de 114,498 toneladas de caña al suelo, recibidas entre el 15 de agosto de 2016 y el 31 de enero de 2017, las cuales no fueron usadas en la producción de etanol, sino tiradas al suelo para utilizarlas como capa vegetal, y cuyo valor alcanzaba los $9.121.202.800,25.
