La ley que eliminaba la casa por cárcel para los condenados por delitos de corrupción se hundió en el Congreso el pasado miércoles después que había pasado todo el proceso de aprobación en la Cámara y el Senado porque no se dio el trámite de conciliación de textos entre las dos cámaras. El proyecto de ley hacia parte del paquete de medidas para luchar contra la corrupción que se incluyeron en el referendo del 26 de agosto del 2018 sobre la materia y que obtuvo 11.645.000 votos, el 31.5% del censo electoral, un poco menos del 33% necesario para que las normas incluidas en la consulta se hubieran convertido en ley de la república. Es bueno decir que este referendo sólo fue promovido por los partidos de izquierda y alternativos y contó con la clara oposición de la derecha uribista y con la indiferencia de los partidos de Centro Derecha que han venido gobernando el país.
En esta consulta anticorrupción se pedían volver más drásticas las penas en contra de este tipo de delitos, y una de ellas era que los sancionados por los mismos no pudieran tener casa por cárcel como sucede ahora, cuando los grandes ladrones de cuello blanco que logran ser condenados, purgan su condena no en la cárceles del Estado como los otros delincuentes, sino en sus casas. De manera que con la plata robada al erario público construyen grandes y lujosas mansiones para que en caso de ser pillados en su picardía, puedan disfrutar en ellas, la mejor de las condenas.
Vi el rostro de tristeza y dolor del senador Gustavo Bolívar de los Decentes. Cuando dejaba una constancia sobre el episodio y decía que el pueblo colombiana tenía razón cuando sindicaba el Congreso de ser un “nido de ratas”. El presidente del senado, nuestro paisano Ernesto Macías, que debe tener una alta cuota de responsabilidad en el hundimiento de la ley, le pidió airado que respetara la “noble” institución del Senado, cuando Bolívar salía consternado por el acontecimiento.
El anterior Contralor General de la República, Eduardo Maya Villazón, dijo a principios del 2018, que en Colombia se pierden cada año por efecto de la corrupción, una cifra cercana a los 50 billones de pesos, cuatro veces más que los que espera recaudar Duque cada año con su pasada reforma tributaria. Cuando al referendo anticorrupción no pasó, los dirigentes de los partidos tradicionales dijeron que aprobarían esas leyes en el Congreso. Hoy vemos como las aprueban
