252525;">En el raro interregno entre lo que pudo haber sido y lo que puede ser, lo que ahora tenemos es el testimonio estremecedor de una mujer que fue violada por su jefe.
252525;">En la columna de El Espectador que tituló “00aaff; text-decoration: none; text-underline: none;">Una defensa del silencio”, Claudia Morales nos hizo revivir, con unas pocas frases magistrales, la sorpresa y la impotencia de la víctima arrollada por la soberbia animal del victimario:
252525;">“Una mujer joven termina su jornada laboral, llega a su hotel…Alguien golpea en su habitación…es su jefe. Abre, “Él” la empuja…la lleva hacia la cama. Ella, que siempre tiene fuerza, la pierde, aprieta los dientes y le dice que va a gritar. “Él” le responde que sabe que no lo hará. La viola”.
252525;">Ese mismo testimonio está escrito con variantes del horror y con tinta indeleble e invisible en el recuerdo de miles de colombianas de todas las edades, de todas las regiones, los estratos y las etnias. Y una fracción de estos testimonios también se encuentra escrita con la tinta borrosa y farragosa de las denuncias y las resoluciones judiciales.
252525;">Tomando solo los casos registrados, y según 00aaff; text-decoration: none; text-underline: none;">se desprende de los datos de Medicina Legal, en este país nuestro “cada seis horas matan a una mujer, cada media hora violan a una y cada 10 minutos a alguna le pegan en la casa”. O según 00aaff; text-decoration: none; text-underline: none;">la Encuesta Nacional de Demografía y Saludque incluyó la pregunta, la violencia de género ha afectado al 74 por ciento de las colombianas.
252525;">No me extiendo en las cifras porque no son confiables -o en todo caso nadie puede precisar la oceánica extensión de este fenómeno-. Pero las pistas anteriores bastan para mostrar que los abusos sexuales en sus distintos tipos y matices son una pesadilla que se ha ensañado y se sigue ensañando contra una multitud de colombianas.

252525;">La pesadilla ha existido por siglos, pero esta vez las mujeres decidieron romper el silencio. Como escribió el 00aaff;">New York Times , “Por primera vez en la historia a las mujeres se les está creyendo, y los hombres poderosos están cayendo como las fichas de un dominó”.
252525;">La ficha que desató el derrumbe fue la denuncia de más de 80 mujeres contra 00aaff;">Harvey Weinstein, el poderoso productor de Hollywood. La actriz Alissa Mylano revivió el hashtag 00aaff;">#Me Too que tuvo varios millones de publicaciones en 00aaff;">por lo menos 85 países, mientras seguía el “dominó” de poderosos del cine y de los medios, congresistas y altos ejecutivos que renuncian o son destituidos por abusos sexuales.
854fa0;">ff00ff;">la columna de Morales es la erguida “defensa de un silencio”. El que cada una de las víctimas tiene el derecho de escoger en la intimidad de su conciencia y por motivos que nadie más puede juzgar.
252525;">En Colombia 00aaff;">#Yo También había tenido un eco amplio, y el tema había sido objeto de numerosas controversias. Pero las denuncias en medios masivos no habían sido formuladas por mujeres destacadas (con la excepción de las actrices y cantantes que aparecieron en el programa “La Red” de 00aaff;">Caracol TV), ni habían afectado a personajes de relieve nacional (salvo tal vez a los 00aaff;">dos futbolistas y a 00aaff;">Gustavo Rugeles).
252525;">Y esto fue lo que cambió con la columna de Morales, cuando se fueron conociendo los nombres de sus antiguos “jefes”. Aunque no es claro si faltan algunos o si alguno de los mencionados no califica como “jefe” -y el “detalle” es importante-, en su brillante carrera periodística y en orden cronológico figuran siete jefes: Juan Carlos Pastrana en La Prensa, Álvaro Uribe en Presidencia, Yamid Amat en CM&, Julio Sánchez en La W, Darío Arizmendi en Caracol Radio y Hernán Peláez junto a Gustavo Gómez en “La Luciérnaga” de Caracol.
LA MEDIA DENUNCIA
252525;">Además del testimonio de una violación, la columna de Morales es la erguida “defensa de un silencio”. El silencio que cada una de las víctimas tiene el derecho de escoger en la intimidad de su conciencia y por motivos que nadie más puede juzgar.
252525;">Es el silencio de Marcela González, la compañera de Rugeles que 00aaff; text-decoration: none; text-underline: none;">se retractó tras haberlo denunciado y decidió a Morales a romper su silencio como “un llamado a entender que cada uno de quienes hemos sido abusados tenemos mundos distintos. Este texto es una forma de invitarlos a callarse cuando no haya nada bueno por aportar”.
252525;">Pero tanto el silencio de Marcela como el silencio de Claudia son silencios a medias.
252525;">No porque en uno o en ambos casos la víctima hubiera esperado años -e incluso muchos años-, para contar su tragedia. Esta es la crítica distante y legalista que el policía le formula a la víctima porque al pasar el tiempo ya no existen las pruebas. Y este es el argumento entre efectista y cínico que esgrime el victimario: “¿por qué esperó tanto tiempo?”.
252525;">La demora de la víctima es otra forma del horror, es la vergüenza y el miedo y la creencia de que será inútil denunciar, hasta que el tiempo o el coraje o el cambio de las circunstancias le permitan narrar su pesadilla. Marcela y Claudia fueron dos de estas víctimas.
252525;">Pero González se calló después de haber hablado y Morales rompió su silencio en paradójica defensa del silencio. Y con esto pasaron irreversiblemente de la privacidad de su conciencia a la palestra pública donde las cosas cobran vida propia y tienen consecuencias jurídicas, morales y políticas.
252525;">Y aquí hay una diferencia: González denunció a su compañero en tanto que Morales denunció a su jefe. El compañero de González es Gustavo Rugeles, pero Morales ha tenido varios jefes.
252525;">La víctima de una violación tiene el derecho de no decir quién la violó. También puede ocurrir que no lo sepa porque no lo conoce, o no lo vio, o no está muy segura de si fue el tío Juan o el Tío Luis.
252525;">Pero Claudia Morales no tenía el derecho de acusar a seis personas inocentes por no decir el nombre del que sabe culpable. Con su silencio a medias y su denuncia a medias, la víctima acabó por enlodar a seis hombres inocentes y cuya integridad moral es importante para los colombianos.
252525;">A causa de una injusticia, la víctima cometió otra injusticia. Pero como hace siglos escribió San Agustín: “Una injusticia no justifica jamás otra injusticia”.
EN MANOS DE LA LEY
La violación es un delito en Colombia. Como si estuviera describiendo sin dolor la pesadilla de Claudia, dice el Artículo 215 del Código Penal: “Acceso carnal violento. El que realice acceso carnal con otra persona mediante violencia, incurrirá en prisión de doce (12) a veinte (20) años».
Y también, para el caso de Marcela, dice con frialdad el Artículo 229 de ese código: “Violencia intrafamiliar. El que maltrate física o psicológicamente a cualquier miembro de su núcleo familiar, incurrirá…en prisión de cuatro (4) a ocho (8) años”.
Pero en el derecho procesal hay una vieja distinción entre delitos querellables- que solo pueden ser investigados por decisión y voluntad de la víctima- y delitos oficiosos – que las autoridades deben investigar aún a falta de denuncia o voluntad de la víctima. La diferencia se basa en qué tan grave sea el daño de la víctima en relación con el daño social del delito respectivo, y las clasificaciones por supuesto varían de país a país.
ff00ff;">Tanto el silencio de Marcela como el silencio de Claudia son silencios a medias.
Hay consenso sin embargo en que todos los delitos violan derechos de los ciudadanos y deben ser investigados de oficio, salvo aquellos que expresamente sean exceptuados como querellables. Pues bien:
- La violación es un delito oficioso en Colombia, porque el Código de Procedimiento Penal (CPP) nunca la incluyó en la lista de los que son querellables (Artículo 74).
- En cambio la violencia intrafamiliar (el caso de Marcela) si figuraba en la lista de delitos querellables porque era visto como un “asunto privado”. Pero precisamente para acabar con la impunidad frente a un delito silenciado, la bancada femenina en el Congreso logró la Ley 1542 de 2012 , cuyo Artículo 1 dice que “La presente ley tiene por objeto… eliminar el carácter de querellable y desistible del delito de violencia intrafamiliar”. Y en su sentencia C-022 de 2015, la Corte declaró que está reforma se ajustaba a la Constitución, o sea que el Estado colombiano tiene la obligación de investigar y sancionar este delito independientemente de lo que quiera la víctima.
De modo pues que la leche se regó y que la Fiscalía está cumpliendo apenas su deber cuando anuncia que abrió investigación sobre el caso Morales, igual que seguirá con el caso Rugelespese a la previa retractación de Marcela.
Claudia Morales por su parte ha dicho que si la Fiscalía la llama a declarar, se acogerá a su “derecho de guardar silencio”. Supongo que a estas alturas la periodista está bien asesorada, pero no creo yo que exista ese derecho: en consonancia con la Constitución (Artículo 33), el CPP en su Artículo 68 sólo exonera del deber de declarar contra el cónyuge o los parientes más cercanos (y a diferencia, por ejemplo, de Estonia, donde un testigo puede no declarar invocando “razones personales”).
Aunque suene chocante, esto resulta simplemente de que estamos ante un delito oficioso, donde el Estado puede y debe conminar a todos los testigos, salvo aquellos que expresamente fueran exceptuados por la ley (en nuestro caso el cónyuge o el pariente cercano).
Tener que recontar su pesadilla ante un fiscal- peor todavía, ser demanda por daños al buen nombre del violador o de alguno de sus jefes inocentes- sería sin duda prolongar la agonía y agravar el vejamen que ya ha sufrido Claudia.
Peor todavía, la Fiscalía o el juez podrían concluir – después de mucho tiempo y con argumentos más o menos discutibles- que técnicamente no hubo violación, o que el caso prescribió, o que las pruebas no son suficientes para que el violador pague los “doce (12) a veinte (20) años” de prisión que mandaba la ley.
Este es el precio de vivir en un Estado de derecho. Es la cara gemela y odiosa del mito que inventamos para dejar de matarnos los unos a los otros: hay un árbitro imparcial y soberano (nuestros jueces casposos), que de acuerdo con reglas precisas determina la verdad y sanciona a los culpables, de manera que solo esa es la verdad y solo son culpables los que los jueces declaren culpables.
Lo demás son opiniones y pasiones.
RUMORES CON CONSECUENCIAS

Aunque no pueden llegar a la verdad ni a la justicia, las opiniones y pasiones en torno a la columna de Morales ya están circulando, con efectos morales y políticos palpables que están al borde de volverse vendaval.Marchas en el país en contra de la violencia hacia las mujeres.
Para empezar, el caso tiene los tres ingredientes que le dan su carácter explosivo a unas pocas de las miles de denuncias que circulan por #Me Too: (i) que el acusado sea un personaje destacado o influyente, (ii) que el abuso se base en el poder del cargo, y (iii) que tanto la denunciante como la denuncia parezcan ser creíbles. Pues bien,
- Es obvio que Morales se refiere a un personaje de alta figuración e influencia en Colombia;
- Es obvio que el presunto violador era su jefe, y
- La historia que relata es muy creíble, porque se trata de una periodista intachable y una mujer autónoma que muestra su dolor de manera genuina. Pero como es inevitable, hay quienes dicen que todo es un invento y menudean los ataques personales contra Claudia.
Los tres rasgos anteriores aseguran el interés del público y la “bola de nieve” a través de las redes y los medios. Pero una vez aquí, hay toda clase de lecturas superficiales o envenenadas, y se forman “partidos” que a fuerza de simplismos, sandeces y bajezas van moldeando el impacto sobre acusada y acusados, sobre el sentido popular de la moralidad, sobre la puja política inmediata y –eventualmente- sobre el legado del principal protagonista de la historia reciente de Colombia.
DETECTIVISMO BARATO
El episodio tiene otro ingrediente que captura todavía más audiencias: el suspenso sobre la identidad del violador.

Por eso en las redes y en las calles asistimos a una ola de teorías o conjeturas o malicias o sospechas sobre cada uno de los involucrados. Morales suelta -o alguien recuerda- pistas que descartarían a algunos de sus jefes, y por el otro lado añade pistas que como sombras chinas nos van mostrando quién es “Él”:
- Claudia dijo en Bluradio que Harvey Weinstein es un “pobre imbécil” comparado con Él y que “ustedes (a Él) todos los días lo oyen y lo ven”;
- En La W añadió que Él, “de alguna manera, es una figura relevante en nuestra historia”,
- O aún, para los que hilan delgadito, dijo desde un comienzo que había callado porque “mi papá (exvicecomandante de la Fuerza Aérea) estaba en una posición laboral que yo debía proteger”.
Los actos se parecen a su autor – o como dijo Sartre, “cada carácter es un juramento”- y de este modo cada colombiano trata de encajar el acto de aquel bruto que violó a Claudia Morales con la imagen que cada uno tiene sobre el carácter de cada uno de los siete personajes.
Un violador y seis hombres inocentes han poblado y despoblado la imaginación de los miles de personas que los siguen y que ahora se encuentran obligadas o se arrogan el derecho de decidir quién es el criminal.
Y en esta especie de infierno sartreano, los siete jefes no saben cómo reaccionar:
- “Explicación no pedida, culpa asumida”. Hasta las expresiones abiertas o sutiles de solidaridad con la denunciante corren el riesgo de ser tomadas como muestras del cinismo de un violador que sabe que la víctima no lo va a delatar.
- Morales dice que “muchos” de sus exjefes (pero no “Él”) la “han contactado en los últimos días”, y se dice que ella ha “hablado bien” de algunos de ellos. Toda una charada.
- Pero el ruido en las redes y en los medios hizo hablar a Álvaro Uribe: “Omito comentar sobre el burdo ataque político. He sido decente con las mujeres a lo largo de mi vida”.
El Centro Democrático (CD) rechazó las “insinuaciones injuriosas de los malquerientes” de su líder y precisó las comitivas y alojamientos de los cuatro viajes que el presidente habría compartido con su jefe de prensa (solo en dos ocasiones se habrían alojado en una misma edificación).
Y para aquellos que hilan delgadito, el comunicado del CD añade que “por protocolo de seguridad, siempre había personal de la policía en la puerta de la habitación del señor presidente. Así le debe constar al coronel (r) Mauricio Miranda, esposo de Claudia Morales, quien perteneció a la seguridad personal del expresidente entre 2002 y 2008”. Claudia responde que “mi esposo en ese momento no era mi pareja”. Y sigue la charada.
CONFUSIÓN Y CLARIDAD
252525;">De esta manera el secreto doloroso de Claudia Morales se recreó y se deformó al traducirse en la frialdad oscura de un proceso judicial o en la cacofonía de las redes sociales donde hay simpáticos y antipáticos en lugar de inocentes y culpables.
252525;">De lo privado a lo legal y al parloteo sin tino de las redes sociales a la caza de “la” pista decisiva, hasta acabar en el simplismo obtuso de un país que vive de amar u odiar a un gobernante cuya grandeza o enanismo moral tendremos todavía que explicarles a nuestros hijos.
252525;">Y en estas condiciones hay que pedirle a esa mujer valiente que por encima de su dolor sin nombre nos diga el nombre del que causó el dolor. El derecho moral y legal al silencio de la víctima termina donde empieza el derecho de los colombianos a la verdad de los hechos y a la justicia de los tribunales.
