Las personas abajo firmantes, convencidas de que los derechos humanos son la base de la relación entre el Estado y la sociedad, estamos altamente preocupadas por la grave crisis de garantías para la participación política y el ejercicio de derechos, especialmente por parte de defensores de derechos humanos y activistas sociales.
Más allá de debates semánticos, reconocemos la persistencia de patrones de violencia en función de poderes y negocios que perduran en disputas territoriales, por rentas y formas de hacer política. Al amparo de discursos de odio y de una rampante corrupción, actúan grupos que estigmatizan a los líderes sociales que se oponen a sus intereses y defienden las comunidades, recursos, y territorios.
Al servicio de un complejo narco-paramilitar actúan grupos armados ilegales y agentes de violencia que, entre muchas de sus acciones, vienen atacando los liderazgos sociales comprometidos con la paz, la defensa de los derechos humanos y con la reconstrucción del tejido social y comunitario.
El Estado tiene la obligación de garantizar la protección adecuada de ese liderazgo, no hacerlo constituye un delito de omisión y un desconocimiento a los principios rectores de la Constitución. Negar la persistencia de diversos patrones de violencia contra el liderazgo social, territorios y comunidades, alienta a quienes promueven estas acciones y pone en serios riesgos la implementación del acuerdo de paz. El mapa de asesinatos y amenazas a defensores de derechos humanos y líderes en las regiones y de ataques a organizaciones sociales, muestra la realidad y dimensión de la crítica situación y la necesidad de respuestas efectivas de prevención, protección e investigación.
A esto se suma, una serie de detenciones arbitrarias, como la realizada contra personas y organizaciones sociales defensoras de derechos humanos del Sur de Bolívar y en otras zonas del país. En al menos uno de los casos la Fiscalía argumenta la necesidad de una medida de aseguramiento intramural, ante el “peligro” que representa para el Estado y la comunidad promover marchas, lo que es un derecho en cualquier Estado que se precie de ser democrático. Lo que está en juego no es solamente la presunción de inocencia de unas personas, ni su derecho al ejercicio de la protesta social sino, además, la posibilidad real de la construcción de paz.
Las personas firmantes pedimos que el Estado, más allá de expresar buenas intenciones, actúe de manera adecuada y oportuna, previniendo nuevos ataques y garantizando la adecuada protección del liderazgo social. Igualmente pedimos que actúe frente a los graves errores de administradores de justicia que proceden contra el derecho y fortalecen dinámicas de estigmatización. Pedimos algo elemental para todos: el derecho a tener derechos.
Es la hora del cese de todas las hostilidades, incluidas la estigmatización, el uso arbitrario y desproporcionado de la fuerza o de instrumentos judiciales y, por supuesto el cese de todo atentado a la vida, a la libertad y a los derechos humanos.
