La Autoridad Nacional de Licencias Ambientales, ANLA, rechazó el recurso de reposición que presentó EMGESA, que pretendía invalidar la convocatoria a la Audiencia Pública Ambiental, solicitada por la Gobernación del Huila para revisar el cumplimiento de las compensaciones por la construcción de la hidroeléctrica El Quimbo.
“Rechazar el recurso de reposición presentado por la Empresa EMGESA S.A. E.S.P. a través de escrito radicado No. 2016043718-1-000 del 29 de julio de 2016 contra el Auto 2997 del 11 de julio de 2016 ‘Por el cual se ordena la celebración de una audiencia pública ambiental, se realiza un cobro y se toman otras determinaciones’, de conformidad con las razones expuestas en la parte considerativa del presente acto administrativo”, advierte la ANLA a través del artículo primero del Auto No. 03871 de julio 23 de 2016.
De acuerdo con la ANLA, en contra de esta decisión “no procede recurso alguno”, y queda en firme con su publicación y notificación, de la cual ya se informó al gobernador del Huila, Carlos Julio González Villa.
En consecuencia, la audiencia se realizará tal y como está previsto en su convocatoria, en septiembre venidero en Garzón, uno de los municipios en el área de influencia de El Quimbo.
EMGESA había expresado su rechazo a la convocatoria a la audiencia, al argumentar que sus acciones y decisiones “han estado amparadas en los autos de seguimiento y las resoluciones modificatorias de la licencia expedidas por la ANLA, razón por la cual ha cumplido con sus obligaciones y el Auto 2997 no puede intempestivamente cambiar la estabilidad de una decisión por cuanto sería una clara infracción a la confianza legítima, ocasionando un grave perjuicio a la compañía”.
El Auto 2997 del 11 de julio de 2016 “ordenó la celebración de la Audiencia Pública Ambiental de seguimiento respecto del Proyecto Hidroeléctrico El Quimbo, a solicitud de la Mesa Temática por la Defensa del Territorio y el Agua del Huila, donde se buscan respuestas de EMGESA para el cumplimiento pleno de las compensaciones por las afectaciones sociales, ambientales y económicas que generó la construcción de El Quimbo.
