Por Liga contra el silencio (Círculo de Periodistas de Bogotá).
“¿Usted sabe cómo se mueren los sapos?”, fue la advertencia que una voz desconocida le hizo al periodista Gerson Gil, director del portal Sahagún 180 Grados, a finales de junio en una llamada telefónica. Asustado, recordó lo ocurrido dos años atrás cuando un hombre, con pistola al cinto y cerca de su vivienda, lo amedrentó para que detuviera sus investigaciones.
Aquella vez, en 2018, indagaba posibles irregularidades en la construcción de la sede de la Universidad de Córdoba en ese municipio. Dicho proyecto, iniciado en diciembre de 2015 y que aún no ha sido entregado oficialmente, tuvo dos suspensiones y dos prórrogas en el tiempo de ejecución, que cambió de 18 a 24 meses, y en el valor, pasó de 16.800 millones a 20.600 millones de pesos.
Y este año, con el olfato de un sabueso, había empezado a investigar presuntos sobrecostos en la compra de uniformes por parte de la Alcaldía de Sahagún.
Con el valor de los reporteros que en Córdoba deciden crear opciones de información alejadas de la pauta oficial de las administraciones, durante casi tres años Gil había soportado que a sus redes sociales y las de su medio llegaran improperios, intimidaciones y amenazas de personas que, refugiadas cobardemente en el anonimato de internet, veían en él a un enemigo del municipio. “Quería darle un giro a la forma en la que se informa en Sahagún, para hacerlo de manera independiente”, dijo Gil a La Liga.
Sin embargo, tras la última amenaza recibida y con el miedo de no tener garantías para continuar su labor, decidió cerrar la página de Facebook donde funcionaba su medio. “He pensado que no concibo seguir ejerciendo un trabajo coaccionado por lo que pueda o no pueda decir […] No somos un medio de oposición, ni de ataque, decimos lo bueno y lo malo, pero en Sahagún el que opina diferente recibe ataques”, aseguró el reportero a El Universal. La de Gil no es una historia aislada, otros reporteros en ese departamento han pasado por situaciones similares.
Otro periodista de Sahagún, a quien protegemos su identidad, lleva 20 años investigando y poniendo en evidencia los hilos del poder en el municipio. Su trabajo ha revelado casos de corrupción que han involucrado a algunos líderes influyentes de la región que hoy están presos por corrupción. El reportero tuvo que dejar su pueblo por varios meses debido a que sufrió un atentado. En la fachada de su casa aún permanece el rastro de la violencia. “Todavía están en la puerta las marcas de los tiros. No las he quitado como para tenerlos de recuerdo”, cuenta y se ríe de su suerte.
Esta situación, que refleja la cotidianidad de lo que viven los reporteros que se dedican a la investigación en ese departamento, resulta preocupante para el presidente del Círculo de Periodista de Córdoba, Orlando Benítez Quintero, pues, para él, esas situaciones son las consecuencia de que los políticos no admiten críticas. “Tenemos una cultura política donde no se admite una investigación periodística en profundidad, y cuando un periodista intenta señalar algún tema que toca alguna fibra de un político es declarado enemigo público de ese político”, le dijo Benítez a La Liga.
El municipio de las jefaturas regionales
“No hay cosa mejor que tener poder, es mejor que tener plata”, decía con frecuencia el fallecido exsenador y exgobernador de Córdoba, Jorge Ramón Elías Náder. Esas palabras se convirtieron en una consigna que los dirigentes de esa zona llevan en su ADN político.
A pesar de que Sahagún es un municipio de la sabana cordobesa, cuya población apenas supera los 90 mil habitantes, ha marcado récords y se ha quedado en la retina de analistas e investigadores por su capacidad de ser la incubadora de congresistas y empresarios que han terminado presos o en problemas judiciales por sonados escándalos de corrupción a nivel regional y nacional.
Desde mediados del siglo pasado hasta la fecha, 18 personas oriundas de esa antigua provincia ganadera han ocupado una curul en el Congreso, cuando hay departamentos enteros que en elecciones ni siquiera logran participación en esa corporación. Entre ellos están los exparlamentarios Bernardo “el Ñoño” Elías (condenado por el escándalo de sobornos de la constructora Odebrecht), Musa Besaile (sindicado por el llamado “Cartel de la Toga”) y Miguel Alfonso de la Espriella (condenado por parapolítica), por citar algunos ejemplos.
A esta lista se suman contratistas como Emilio Tapia, condenado por su participación en el entramado de corrupción conocido como “el carrusel de la contratación en Bogotá”; Otto Bula, exsenador y condenado lobbista de Odebrecht; y Gabriel Dumar, empresario y otrora socio político del “Ñoño”, también condenado por los sobornos de la constructora brasileña.
Estas relaciones, que han trascendido del poderío regional al nacional, han sido documentadas y reconstruidas por la investigadora especialista en antropología política, Gloria Isabel Ocampo, en sus libros “Poderes regionales, clientelismo y Estado” y “¿Cuál Estado para cuál ciudadanía?”. En estos, ha explicado cómo se ha construido el dominio político en Córdoba por medio de los lazos sociales, el parentesco y el clientelismo electoral.
En un aparte dedicado a Sahagún narra las relaciones de poder que allí se gestaron desde antes de que se conocieran a nivel nacional los fenómenos de Bernardo Elías y Musa Besaile, con familias acaudaladas y tradicionales como los Náder, los Bula y los De la Espriella. Según Ocampo, por la participación de estos linajes -algunos de origen árabe- en la política, “Sahagún ha sido descrito como un enclave de la diáspora sirio-libanesa”.
“Era una gente que estableció un tipo de clientelismo que era muy eficaz en Córdoba, una ligazón muy fuerte con las localidades y la región. Por ejemplo, la trayectoria del “Ñoño” que, tras heredar el capital político de su tío (Jorge Elías Náder), logró posicionarse electoralmente a través de la repartición burocrática y de recursos públicos que se hacía a través de la política”, aseguró Ocampo en entrevista con La Liga.
“Acá la gente nace escuchando de política. Aquí la política se hace desde los corredores, en las calles, en los parques y siempre la gente está en un bando. Desde la época en que tengo uso de razón, salieron a hacer política los grupos de los De la Espriella, Elías, Náder y de últimos, los Besaile”, manifestó el periodista sahagunense a quien no identificamos.
Las dotaciones de la censura
El último episodio de censura ocurrido en Sahagún toca al periodista Gerson Gil, quien al recibir esa llamada intimidatoria, decidió -por mera supervivencia- hacerle caso a las palabras del hombre que lo amenazó: detuvo la investigación que estaba llevando a cabo y cerró su página de Facebook.
El tema que no pudo publicar fue un contrato por 106.056.464 pesos para la dotación de uniformes para el personal docente administrativo del municipio que suscribió la Alcaldía de Sahagún.
A pesar de la emergencia económica por el coronavirus y de la necesidad de que los gobiernos locales, regionales y nacional sean austeros, el alcalde Jorge David Pastrana Sagre -electo en una coalición del Partido de la U y Cambio Radical- invirtió recursos en 202 dotaciones que dichos funcionarios no van a usar porque están trabajando desde casa. La administración justifica este gasto amparándose en darle cumplimiento a la Ley 70 de 1988 que establece que se debe entregar dotación a los empleados que devenguen menos de dos salarios mínimos.
El contrato 094 de 2020 tiene como objeto suministrar las dotaciones al personal administrativo docente, femenino y masculino, que presta sus servicios en las instituciones educativas oficiales de Sahagún y del personal administrativo del municipio. La indumentaria consta de un pantalón, una camisa y un par de zapatos.
Según la ficha técnica, estas se están entregando a 68 trabajadores en total, de los cuales 25 son del área administrativa docente y 43 del área administrativa. El suministro de dotaciones se empezó a entregar el 30 de mayo y continuará los próximos 30 de agosto y 20 de diciembre. La contratación establece que por cada uniforme se paga 525.032 pesos.
El proceso de convocatoria se hizo con algunos requerimientos específicos que limitaban la participación de empresas que no tuvieran su domicilio en Sahagún. En marzo de 2020 se pidió además que fuera una micro, pequeña o mediana empresa radicada en Sahagún, requisito que cumplía la Comercializadora y Distribuidora LD, representada legalmente por Yojana Almanza Brun, que ganó la licitación.
En sus cinco años de funcionamiento, dicha compañía ha celebrado 91 contratos con distintos colegios y alcaldías de Córdoba y Sucre a los que les ha vendido enfriadores, elementos de cocina, materiales de construcción, papeles, sillas y escritorios. Asimismo, lo ha hecho con las alcaldías de Tuchín, Montelíbano -a la que también le surtió uniformes-, Cereté, Momil, Chinú, Ciénaga de Oro, San Andrés de Sotavento y Purísima.
Esta empresa, que cuenta con un activo de unos 372 millones de pesos, está en capacidad de vender 258 productos diferentes, que van desde chocolates y arneses, hasta dispositivos informáticos de entrada de datos, equipos de rescate y bicicletas de motor (ver registro único de proponentes).
Su poder en la contratación pública en esta región ha llegado hasta municipios sucreños como San Marcos, La Unión, Caimito y San Benito Abad, además de varias instituciones educativas de ese departamento, con las que ha firmado contratos por montos que van desde siete hasta 150 millones de pesos.
La Alcaldía de Sahagún ya había contratado con la misma firma en los últimos meses de la administración del exalcalde Baldomero Villadiego (2016-2019) para entregar elementos didácticos y tecnológicos de preescolar en los colegios oficiales.
En la competencia por esta licitación estuvieron siete empresas. Entre ellas: Almacén Los Muchachos, Variedades El Punto del Bebé, Fundación para el Desarrollo Integral de la Comunidad, Fundación Labriegos por la Paz, Fratos Vélez S.A.S e Industrias SAB (las últimas cuatro de Montería).
No obstante, los requisitos exigidos por la Alcaldía fueron criticados por Crisalltex S.A (Almacenes Gino Pascalli) aduciendo que en el pliego de condiciones hay una evidente diferencia entre los indicadores que exige Colombia Eficiente y los que fijó el municipio de Sahagún. En sus observaciones al pliego de peticiones señalaron que ni siquiera en el estudio más grande a nivel nacional -en cuanto a proveedores de dotaciones, ropa de vestir y calzado- se han fijado parámetros iguales para ser aptos.
“Los indicadores antes anunciados son imposibles de cumplir por una empresa consolidada”, resaltaron (ver documento). Aún así, no siguieron haciendo más objeciones cuando la administración estableció que debían ser empresas locales.
La Liga revisó el contrato y la ficha técnica -en la que se definieron las características de las dotaciones y el número de personas que las están recibiendo-, y encontró que hay varias inconsistencias como, por ejemplo, que la ficha técnica muestra que serán 11 mujeres y 14 hombres (25 en total) del personal administrativo docente los beneficiados con los uniformes. Al multiplicar ese valor por las tres entregas que se llevan a cabo, el resultado es 75, pero en el documento dice 73. No obstante, en el contrato firmado por el alcalde Pastrana y la empresa contratista, el valor cambió a 76, lo que sigue siendo incorrecto.
En segundo lugar, la cifra del personal administrativo del municipio no coincide en lo estipulado en la ficha técnica y el contrato, pues en el primero consta 129 y en el segundo, 126.
Y, en tercer lugar, las matemáticas, o la desatención, les volvieron a fallar a quienes elaboraron y revisaron el proceso. Inexplicablemente, la multiplicación de 76 (personal administrativo docente) por 525.032 pesos (valor de las dotaciones) les dio 39.450.576 y no 39.902.432 pesos, como resulta al hacer la operación.
Al sumar esa última cifra (39.902.432) y la correspondiente al precio de los atuendos del personal administrativo del municipio (66.154.032), el resultado es el precio del contrato (106.056.464 pesos). Así, el detalle solo sería un error humano al hacer la operación, pero como el número de dotaciones es diferente al determinado en la ficha técnica, el costo final varía. Si la operación se hiciera con los datos correctos (75 y 129, las cifras de la ficha técnica) el valor final sería de 107’106.528 pesos.
En los documentos de este proceso que fueron subidos al Sistema Electrónico de Contratación Pública (Secop) no hay uno que explique o aclare el porqué de la disparidad en las cifras aquí señaladas, aun cuando en dicha plataforma deben subirse todos los archivos de las licitaciones.
Cuestionado sobre estas inconsistencias, Pastrana le respondió a La Liga:
“No sé. La verdad es que no tengo claro eso. Me tocaría llamar a la oficina jurídica a ver si fue un error humano o a qué obedece ese error. De igual manera, en el acta de liquidación se paga lo que se recibe”.

El abogado especialista en derecho público y derecho penal, Gildardo Acosta, señaló que este desorden en los números, y sin una justificación que esté publicada, “son cambios que representarían una conducta punible de celebración de contratos sin el cumplimiento de requisitos legales”. Y sobre la respuesta del mandatario, el abogado apuntó que el Alcalde es el ordenador del gasto y, por tanto, debe estar enterado y hacer seguimiento de lo que pase con la contratación.
Otro abogado consultado por esta alianza de medios también recalcó la posible irregularidad que esto significaría, según dijo, en los estudios previos de la licitación deben estar las mismas cifras que luego se consignan en el contrato. “Eso podría ser un hallazgo administrativo, fiscal, disciplinario e, incluso, penal”, aseguró.
Presuntos sobrecostos
En los beneficiarios de la dotación hubo inconformidad por el valor del pagaré que debían firmar a cambio de recibirla. En él, estaban discriminados los precios de las prendas que dan un total de 525.031 pesos (ver comprobante de egreso), un valor considerado alto para lo que fue entregado.
Una de las personas que recibió estos uniformes y que habló para esta investigación con la condición de omitir su nombre, mostró la dotación en la cual se evidencia que la marca de las prendas es Pointer, producida por la Comercializadora Pointer S.A., la cual funciona en Barranquilla y vende prendas de vestir (ver uniformes). Dicha sociedad anónima es más conocida como Cáñamo, almacenes populares que venden prendas de vestir a muy bajo costo.
En dicha empresa, según una cotización realizada por La Liga, los valores son mucho más bajos que los pagados por la Alcaldía incluso tratándose de la misma marca. Por ejemplo, mientras en el comprobante de egreso aparece el pantalón de mujer a 180 mil pesos en la cotización al detal el valor es 48 mil; es decir, 132 mil pesos menos.
En otra cotización de artículos similares realizada en Mercado Libre los precios son también menores a los de la contratación: cerca de 350 mil pesos menos que en el lugar donde contrató la Alcaldía.
La Liga le preguntó al alcalde Pastrana si los precios por los que se está pagando estos uniformes son elevados y respondió: “Hay pantalones de todo precio. Usted va a un almacén y depende de la calidad, pero nosotros no podemos disminuir los precios que nos está otorgando la ley. En el tema de costos nos ceñimos a la ley”.
Sin embargo, ninguna ley contempla fijación de precios de este tipo. Desde 2012 las entidades estatales de cada municipio son las que elaboran las listas de precios, pero son un sistema de referencia interno que no es de obligatorio cumplimiento, según detalla el portal Colombia Compra Eficiente.
Además de esto, en la descripción de cómo debe ser el calzado, dice que la materia prima debe ser cuero. Pero un par de estos que ya fueron entregados a uno de los beneficiarios que nos envió una foto, se aprecia que el material con el que está fabricado es sintético.
Sobre esto, Pastrana indicó que a algunos beneficiarios no les había gustado el diseño de los zapatos y que se los cambiaron, pero que el material de estos sí es de cuero. “Si no son de cuero, no los podemos aceptar porque ahí sí se estaría incurriendo en una ilegalidad”, indicó. Sin embargo, la evidencia muestra otra cosa.
El Alcalde está en la mira de la Contraloría Departamental y de la Procuraduría Regional de Córdoba, las cuales han manifestado sus reparos en el manejo de los recursos para la atención de la emergencia sanitaria por la COVID-19 tanto en Sahagún, como en otros municipios de ese departamento.
La tercera fue la vencida
Jorge David Pastrana, popularmente conocido como el “Davo”, llegó a ser alcalde después de dos derrotas en 2011 y 2015 ante los candidatos de la “Ñoñomanía”, como se conoce al movimiento que creó el condenado exsenador del Partido de la U Bernardo “el Ñoño” Elías y que ahora está en manos de su hermano Julio Elías. El excongresista, a pesar de estar recluido en la cárcel La Picota de Bogotá sigue poniendo alcalde en Sahagún.
A pesar de que fueron enemigos políticos en las dos últimas campañas electorales, Pastrana y el “Ñoño” hicieron las paces para las elecciones de 2019 y consiguieron derrotar a Lucía Tous, quien era apoyada por su hermano José Tous, exrepresentante a la Cámara por Córdoba, y por el también exsenador preso Musa Besaile. Ambos, antiguos aliados de Elías.
“La política es dinámica, son procesos, existen las alianzas y las coaliciones. Por mucho tiempo fui amigo del movimiento de la “Ñoñomanía” y tuvimos diferencias en un tiempo, pero el año pasado se limaron las asperezas”, dijo Pastrana.
El alcalde de Sahagún tiene una relación familiar y contractual que lo vincula con “el carrusel de la contratación en Bogotá”. Su hermano, Manuel Pastrana Sagre, fue asesor de la Empresa de Renovación Urbana y del Instituto de Desarrollo Urbano (IDU) durante la alcaldía de Samuel Moreno en Bogotá (2008-2011) y fue uno de los principales aliados del exsenador Iván Moreno en Sahagún durante su campaña de reelección al Senado en 2010.
Jorge Pastrana también aparece en un informe que la Contraloría de Bogotá realizó en 2012 llamado “Seguimiento a la ejecución de los contratos suscritos con el Grupo Nule”. Según el documento, el hoy alcalde suscribió dos contratos con la Empresa de Acueducto y Alcantarillado de Bogotá (EAAB) en 2006 como integrante de los consorcios y uniones temporales que hacían parte del grupo empresarial encabezado por Guido, Manuel y Miguel Nule.
La compra de estos uniformes se suman a su controvertido pasado que lo liga a uno de los escándalos de corrupción más sonados en el país.
Por el momento, Sahagún -un municipio que tiene mucho por mostrar, pero que casi siempre figura en las noticias como tierra de políticos y de escándalos de corrupción- vive el tercer mandato consecutivo de la “Ñoñomanía” teniendo enfrente una pandemia que, como en otras regiones de Colombia, ha hecho visible las irregularidades en la contratación pública y la intimidación a la prensa que antes pasaban desapercibidas.
Como lo dijo Órlando Benítez del Círculo de Periodistas de Córdoba, “los dirigentes manejan la lógica de ‘si tú no estás hablando bien de mí, entonces eres mi enemigo y aquí no consigues nada’”
