Una auditoría especial hecha por la contraloría General del Departamento, a la administración de Villavieja, Huila, dejó al descubierto, una serie de contratos que firmados en el 2017, se ejecutaron parcialmente, pero se pagaron en su totalidad.
De acuerdo con la información oficial, hubo 23 hallazgos Administrativos, de los cuales 5 tienen presunción disciplinaria, 8 presunción fiscal cuantificados en la suma de $287.374333.42, y uno (1) con presunción penal y un Beneficio de Auditoría en cuantía de $5.200.000.
Llama poderosamente la atención (1) que todos esos contratos recibieron adición y (2) la inexistencia de controles a al manejo de recursos por entradas al desierto y al museo.
DETALLES
Entre los hallazgos con presunta incidencia fiscal, se tienen:
- El Municipio de Villavieja, suscribió con Servicios de Ingeniería, Montajes y Metalmecánicas SAS, el contrato de prestación de servicios No. 79 de 2017, por valor de $95.200.000, cuyo objeto consistió en realizar mantenimiento preventivo y correctivo de la maquinaria pesada del Municipio de Villavieja. Seguidamente se celebró un contrato adicional por valor de $47.600.000, para un total de $142.800.000.
En el proceso de revisión de los documentos que conforman la carpeta, se encontró que hay evidencias fotográficas de los arreglos efectuados a cierta maquinaria, así como en el informe final, se detallan las actividades realizadas, igual que la cantidad de repuestos al parecer utilizados.
Al respecto, se concluye, por una parte, que no se encuentra debidamente justificado el valor adicional, toda vez que en los estudios previos se establecieron claramente las reales necesidades (arreglos y requerimientos de repuestos) a contratar; luego no se encuentra justificación para el incremento en un 50% del valor del contrato, configurándose en consecuencia en un presunto detrimento patrimonial en cuantía de $47.600.000 producto al parecer de una gestión fiscal ineficaz, ineficiente de quien a su cargo tiene la disposición de los recursos públicos, representada en la suscripción de un adicional, en perjuicio al parecer del patrimonio público.
Realizada visita a la maquinaria de la entidad, específicamente al cargador, el cual se encontraba en el centro poblado La Victoria, se observa que se encuentra en un estado de bastante deterioro; luego se desconoce el mantenimiento preventivo y correctivo realizado sobre el mismo; y si pese a efectuarse, se obtuvo beneficio con este.
Lo anterior, producto al parecer no solo de una inadecuada planeación, sino de debilidades en la supervisión y control a la ejecución contractual.
- La Administración Municipal de Villavieja, suscribió con el señor JANUARIO QUESADA VANEGAS, el contrato de suministro No. 33 el 3 febrero de 2017, por valor de $20.600.000, cuyo objeto fue el suministro de combustible para la correcta operación de maquinaria pesada, vehículos y motocicletas de propiedad del Municipio.
Se suscribió contrato adicional por valor de $10.300.000 (incremento del 50%, quedando el total del contrato en $30.900.000), con el argumento según se indica, por las fuertes lluvias en el sector rural, por haciendo necesario la presencia permanente de la maquinaria en las vías para hacerle frente al deterioro de éstas.
En el proceso de revisión, se encontró que la administración tiene establecido para el control del consumo del combustible órdenes de pedido con un formato pre numerado, con la siguiente información: fecha, conductor, cédula, vehículo, placa, detalle del suministro, firmas conductor y de quien autoriza. No obstante, se logra establecer que las autorizaciones de entrega de combustible mediante estas órdenes de pedido no aparecen diligenciadas con esta información, presentándose en consecuencia ausencia total del control en el proceso de tanqueo.
Revisadas las órdenes de pedido expedidas por el secretario de la Oficina de Planeación y cruzando la información con las facturas expedidas por el proveedor se desprende, que el consumo del combustible habría estado direccionado en el arreglo de las vías del municipio para la vigencia 2017, con 2.600 (66%) galones de ACPM consumidos por la Motoniveladora, 1.277 (32%) galones de acpm por la Volqueta y 66 (2%) galones de gasolina para la motocicleta. No hubo consumo de combustible para la retroexcavadora.
Así mismo, se logra determinar que la Administración Municipal, no tiene cronograma de las actividades desarrolladas con la maquinaria pesada, que demuestre el suministro de combustible. Igualmente, no existe documento que justifique el adicional por valor de $10.300.000, toda vez que el argumento fue el incremento de las fuertes lluvias, pero no existen actas del Comité Local de Emergencias donde se indique esta situación, tampoco se observó plan, cronograma o documento alguno que indique las vías prioritarias a atender, y que justifiquen en consecuencia el aumento en el consumo de combustible; y por ende su necesidad.
Teniendo en cuenta lo planteado, se tiene la existencia de un posible detrimento patrimonial cuantificado en la suma de $10.300.000, como consecuencia de la falta de planeación, deficiencias en las medidas de control y de seguimiento de la ejecución contractual.
- El Municipio de Villavieja, suscribió, el contrato de suministros No. 087 del 22 de junio de 2017, por valor de $283.695.000, cuyo objeto consistió en el suministro de materiales para la construcción de pavimento rígido de vías urbanas en el centro poblado La Victoria del Municipio de Villavieja.
De acuerdo con la propuesta presentada por el contratista y que hace parte integral del presente contrato, se tiene lo siguiente:
Posteriormente mediante otrosí No. 001 del 1 de septiembre de 2017, se crea un nuevo ITEM, donde se incluye la compra de 394 kilogramos de antisol a razón de $9.500 cada uno para un total de $3.743.000, y se reduce el cemento en 125 bultos, para un total definitivo de 5.306.
Con respecto a este contrato el equipo auditor logra determinar:
– Se presenta al parecer falencias en el estudio previo para la suscripción del contrato, en cuanto a precios de mercado, cálculo de cantidades y especificaciones técnicas de la obra a construir con los materiales a suministrar.
– El contrato no se ejecutó en el plazo establecido (durante el 2017), toda vez que a fecha de la visita de campo de la auditoría la obra se encontraba en ejecución (se concluyó entre el mes de mayo a julio de 2018), encontrándose almacenado en el puesto de salud de la localidad (Centro Poblado La Victoria) cemento fresco en cantidad aproximada de 700 sacos de 50 kilos, marca FORTECEM y material de playa (arena gruesa de río) apilada en el sitio de la obra; no se encontró el ítem Gravilla.
Por otra parte, y en relación con el ítem Gravilla se tiene, lo siguiente:
Teniendo en cuenta que la ferretería no suministró el ítem Gravilla, contenido en el contrato 087 de 2017, en su defecto, la gravilla fue cernida de la arena gruesa suministrada, se tiene la ocurrencia de un presunto detrimento al patrimonio del municipio de Villavieja cuantificado en la suma de $8.715.000; que resulta de calcular la diferencia ($15.000) entre los valores unitarios del metro cubico de gravilla de $95.000 y el de arena de $80.000 y multiplicado por la cantidad de metros cúbicos de gravilla (581 m3) contratos y obligados a suministrar, según contrato de suministro 087 de 2017.
Lo anterior, como consecuencia al parecer de una inadecuada planeación en la ejecución contractual, así como en el control y seguimiento a la ejecución contractual.
- El Municipio de Villavieja suscribió con el Fondo Mixto de Cultura y Turismo del Huila, el convenio interadministrativo No. 069 del 24 de abril de 2017, por valor de $174.090.000, de los cuales el municipio aportó la suma de $166.090.000 y el Fondo $8.000.000 representados en bienes y servicios, cuyo objeto consistió en aunar esfuerzos técnicos y financieros para la realización del día del Niño, día de la Madre, día del Campesino y celebración de las tradicionales fiestas San Pedrinas.
Como resultado de la evaluación de este convenio, se estableció la existencia de un presunto detrimento patrimonial en cuantía de$132.440.000 discriminado de la siguiente manera:

El Municipio de Villavieja suscribió con el Fondo Mixto de Cultura y Turismo del Huila, el convenio interadministrativo No. 129 del 6 de septiembre de 2017, por valor de $63.990.000, de los cuales el municipio aportó la suma de $60.990.000 y el Fondo $3.000.000 representados en bienes y servicios, cuyo objeto consistió en aunar esfuerzos para la celebración de la época navideña y año nuevo.
Como resultado de la ejecución del convenio No. 129 del 6 de septiembre de 2017, suscrito entre el Municipio de Villavieja y el Fondo Mixto de Cultura y Turismo del Huila, se concluye que una vez efectuado el estudio y análisis total de los soportes que acompañan su ejecución, se tiene la existencia de un presunto daño patrimonial causado al Municipio de Villavieja, el cual se cuantifica en la suma de $40.750.000, causado como consecuencia de la ausencia de evidencias del pago como recibos en los siguientes eventos: Presentación del grupo artístico que amenizó los días 30 y 31 de diciembre de 2017, por valor de $12.000.000; alquiler de sonido profesional para la celebración del fin de año por valor de $13.500.000; No aparecen facturas de la compra de 1.600 detalles navideños para los niños por valor de $12.800.000; ni por el alquiler de transporte público para los días de celebración de la novena de aguinaldos por valor de $2.450.000, valores que alcanzan la suma de $40.750.000.
- El Municipio de Villavieja, suscribió el convenio No. 137 del 9 de noviembre de 2017, con las Empresas de Servicios Públicos, por valor de $58.700.000, de los cuales el Municipio aportó la suma de $56.700.000 y la empresa $2.000.000 (en especie, personal administrativo y logístico) cuyo objeto consistió en: “Aunar esfuerzos técnicos, administrativos y financieros para desarrollar estrategia de prevención para la temporada invernal en las rondas y canales de aguas lluvias del casco urbano del municipio de Villavieja 2017”, con plazo de 1 mes y 21 días.”
Posteriormente, se suscribió el adicional No. 01 del 2 de diciembre de 2017, donde se aumenta la suma de $19.445.000, quedando el convenio definitivamente en $78.145.000, de los cuales el municipio aportó $75.645.000 y la Empresa de Servicios Públicos la suma de $2.500.000.
Para ejecutar el convenio, las Empresas de Servicios Públicos de Villavieja, suscribió con el señor REYNEL ARRIGUI BRAND, el contrato de prestación de servicios profesionales No. 024 del 27 de noviembre de 2017, por valor de $56.700.000, cuyo objeto consiste en prestar los servicios profesionales para desarrollar estrategias de prevención en la temporada invernal en las rondas, parques y canales de aguas lluvias en el casco urbano del Municipio de Villavieja Huila,
La empresa suscribió contrato adicional No. 01 del 3 de diciembre de 2017, por valor de $18.945.000, justificando que se requiere mayor número de horas de retroexcavadora, paleros y poda
Una vez efectuado el análisis y evaluación a los documentos que acompañan el convenio y efectuado el cruce de la información que reposa en la Empresa de Servicios Públicos de Villavieja, con los archivos del Municipio, se tiene lo siguiente:
En el informe final presentado por la Empresa de Servicios Públicos al Municipio, y en el informe presentado por el contratista que ejecutó las diferentes actividades a través del contrato No. 024 de 2017, no se menciona ni se aportan registros fotográficos que evidencien la utilización de la retroexcavadora; además los trabajos mostrados en las diferentes fotografías tienen que ver con jornaleros que realizan actividades de paleros, descopadores de árboles y traslado de materiales en carretillas, lo cual deja ver que son netamente labores manuales, que no requieren al parecer de maquinaria pesada.
De otra parte, no se encontró dentro de los informes de los supervisores tanto del Municipio como de la Empresa de Servicios Públicos, una relación de los recursos utilizados en desarrollo del convenio, tales como: Planillas donde se relacionen las personas que trabajaron como jornaleros con sus respectivos pagos, tipo de maquinaria utilizada y sus respectivos soportes de pago si fue subcontratada, equipos e instrumentos de apoyo utilizados, entre otros.
Con base en los argumentos expuestos, se concluye, que posiblemente en la ejecución de este convenio, se le causó un presunto daño patrimonial al Municipio cuantificado en la suma de $14.280.000, producto de la contratación del servicio de retroexcavadora 8 horas diarias por 21 días a razón de $85.000 la hora.
- En cuanto a la aplicación del nuevo marco normativo de contabilidad pública, Resolución 533 de 2015, la administración municipal, a pesar de que contrató su implementación, su resultado no se evidenció en los Estados Financieros. Hecho observado en el Contrato de Prestación de Servicios No.121 de 2017.
La Administración Municipal afectó el presupuesto de Rentas y Gastos aprobado para la vigencia fiscal 2017, al suscribir el Contrato de Prestación de Servicios No. 121 de fecha 04 de agosto de 2017, por valor de $19.953.333.42, cuyo objeto es: “Brindar Asesoría al municipio de Villavieja en la Implementación, Preparación y Aplicación del Marco Normativo (NIIF) para Entidades de Gobierno de Acuerdo con la Resolución 533 de 2015”.
Evaluada la carpeta que contiene los documentos y soportes de ejecución del contrato 121/2017, el equipo auditor logra determinar que las obligaciones contractuales a cargo del contratista no fueron ejecutadas; toda vez que los informes presentados como soportes de las respectivas actas parciales para los correspondientes pagos sobre actividades realizadas por el contratista y certificados por la administración municipal, éstos, no fueron debidamente acreditados por la Tesorería Municipal, ni por el Contador del Municipio; quien a su vez, es el mismo contratista.
Así mismo, su resultado final no se ve reflejado en las cifras de los Estados Financieros presentados a 31 de diciembre de 2017, siendo posible concluir que el contrato antes mencionado no tuvo ningún impacto y/o beneficio al ente territorial; luego se tornó en una erogación de recursos públicos ineficaz, ineficiente.
Los documentos contables presentados al equipo auditor por parte de la administración municipal, como soporte de ejecución del contrato 121/2017 (doce notas de contabilidad) es el trabajo propio que debe realizar el Profesional de la Contaduría Pública, como contador del ente territorial, responsable de llevar a cabo el proceso contable del municipio. Así las cosas, se tiene la existencia de un presunto detrimento patrimonial cuantificado en la suma total de $19.953.333.42.
- La Administración Municipal de Villavieja, durante las vigencias 2017 y 2018 realizó pagos por concepto de jornales, cuando dicho mecanismo no se encuentra reglado por la legislación vigente en materia de contratación estatal, situación que permite establecer que se pudo presentar un presunto detrimento patrimonial al municipio, cuantificado en la suma de 13.336.000., esto es, sin que medie fuente de obligación, esto es un contrato y ante la carencia total de soportes que evidencien la realización de cada una de las actividades canceladas por este concepto.
BENEFICIO AUDITOR:El Contador del municipio causó contablemente el faltante de dinero determinado en la Tesorería Municipal por valor de $5.250.000, registrado en la sub cuenta contable, 14701202 “Otros Deudores – Créditos a Empleados – Responsabilidades Empleados”, sin que la Administración Municipal a la fecha (Junio/2018), haya adelantado gestión alguna para recuperar el recurso público, al parecer perdido de las arcas de la Tesorería Municipal; generándose en consecuencia, un presunto detrimento al patrimonio del Estado producida por una gestión fiscal antieconómica, ineficaz e ineficiente. (artículo 6, Ley 610 de 2000).
No obstante, lo anterior, la Oficina de Control Fiscal recibió vía correo electrónico copia del recibo de consignación efectuada el día 27 de agosto de 2018 a la cuenta corriente número 039800000182 “Municipio de Villavieja”, Banco Agrario por valor de $5.200.000; no se allega el recibo de caja oficial expedido por la Tesorería Municipal.
Así los hechos, el ente de control lo califica como un beneficio de auditoría dentro del proceso auditor teniendo efecto positivo sobre el presunto detrimento encontrado.
DENUNCIAS CIUDADANAS: Se resolvieron denuncias ciudadanas relacionadas con los ingresos producto de la venta de boletería para el ingreso al observatorio y museo paleontológico de Villavieja, encontrado que:
Legalidad del cobro de Ingreso al Museo Paleontológico y Observatorio: La administración municipal certifica con destino a diferentes entidades que para el cobro de las entradas (al museo paleontológico y Observatorio) el Concejo Municipal no le ha aprobado los proyectos de Acuerdos presentados para establecer estos tributos. En otras, ha certificado que el sustento legal es artículo 82 del Estatuto Tributario Municipal.
Análisis de recaudos: Evaluados los recaudos según los soportes de recibos de caja que reposan en la Tesorería Municipal del municipio de Villavieja, desde el año 2016 hasta el día 20 de junio de 2018, por concepto del cobro por la entrada al Museo Paleontológico y Observatorio Astronómico del Desierto La Tatacoa, el equipo auditor logra determinar:
Los Ingresos recaudados por la Secretaria de Hacienda Municipal por concepto de la entrada al Museo Paleontológico durante el período comprendido entre el año 2016 hasta el 20 de junio de 2018, ascienden a la suma de $64,608,500 y, por el Observatorio Astronómico, el ingreso alcanza la suma de $133,589,700; con recaudos para este último tributo, sólo a partir del 10 de mayo de 2016. Para un gran total de recaudo por los dos de $198,198,200.
La Secretaría de Hacienda Municipal independientemente del concepto del recaudo del tributo (Museo y Observatorio), causa el ingreso al código contable 41109002 denominado «Ingresos Museo y Servicios Turísticos» y al código presupuestal 1102041001 «Venta de Bienes y Servicios – Otros Ingresos de Ventas de Bienes y Servicios diferentes a la Venta de Activos – Ingresos por Museo y Servicios Turísticos», hasta el año 2017.
Sobre la boletería que la Administración Municipal ha implementado para el cobro de estos dos tributos, no es consistente (Boletas – Manillas), debido a que, si bien se encontraron algunos registros de entrega y control sobre las series entregadas, no existe ningún control y seguimiento sobre los mismas, por cuanto los recibos de caja, en su mayoría no tienen anexas las respectivas planillas de ingresos.
Los dineros recibidos diariamente por las entradas al Museo Paleontológico y al Observatorio Astronómicos por personal vinculados a través de contratos de Prestación de Servicios no son entregados de manera oportuna a la Tesorería Municipal para su correspondiente ingreso con recibo de caja, registro y consignación; tardando hasta varias semanas para su entrega.
Se han causado ingresos de la entrada al Observatorio Astronómico como ingresos de Estampillas Procultura; hecho observado en los ingresos recaudados correspondiente a los días del 27 de marzo al 02 de abril de 2017, según recibo de caja número 2017000377 de fecha 03 de abril de 2017, por valor de $230.000.
Según información entregada por el denunciante directamente al equipo auditor dan cuenta que turistas le han entregado copia de boletas y manillas con seriados de numeración altas que sobrepasan los doce mil (personas) que al parecer han sido adquiridas y canceladas por ellos ante la administración municipal o personas encargadas del cobro a la entrada del observatorio astronómico y el museo paleontológico; sin embargo no se encontró en la administración municipal evidencia que así lo soportara; o que permitiera cuantificar sus ingresos.
Con respecto a esta situación no fue posible hacer un cotejo entre las boletas y manillas con las que posee actualmente dispone la administración municipal, debido al desorden, falta de registro de entrega de estas y al deficiente seguimiento y control que existe sobre la entrega y venta de estas.
No se encontró evidencias que indique la venta de manillas y por ende el ingreso de recursos al municipio, por concepto de entrada al observatorio y museo en temporadas especiales y otros eventos (Ejemplo: Festival lluvia de estrellas).
La administración no ejerce un control adecuado sobre el recaudo de estas rentas, pues delega este en cabeza de personal vinculado a través de contratos de prestación de servicios.
Lo anterior, como consecuencia de la inexistencia de reglamentación y control efectivos sobre el cobro por concepto de ingresos a los sitios antes mencionados, lo que puede traer como consecuencia que el municipio deje de percibir recursos.
