La ministra de Justicia, Gloria María Borrero, en la presentación del proyecto de reforma a la justicia del Gobierno, y concretamente sobre el juzgamiento de aforados que mantiene la desprestigiada, inútil e incompetente Comisión de Acusaciones, más conocida como “comisión de absoluciones”, decía que “El gran cambio es que quitamos todo lo que suene penal en la acusación y modificamos la ley quinta y el cuerpo de investigación para agilizar el proceso”.
Pues bien: El gran cambio, que por supuesto no existe, porque lo que se requiere para que lo haya de verdad es una Comisión de Aforados independiente, cualificada y con dientes, sigue la filosofía de cambiar las cosas para que sigan igual como en El Gatopardo de Lampedusa, en tanto lo que se propone son unas reformitas que supuestamente darían agilidad a esta clase de procesos, suprimiendo el juzgamiento penal para que sea solo político, agregándole la creación de un cuerpo de investigación integrado por fiscales de carrera y un término menor a 3 meses para que se adelante el “proceso político”. Mejor dicho, un ejercicio de maquillaje, que equivale a cambiar la etiqueta y el envase, dejando incólume el tóxico contenido, que es la misma Comisión integrada por ignaros manipulables, y sin peso específico, y además de contaminado origen que nunca podrán acusar a nadie por graves que sean las faltas que hayan cometido los aforados como lo hemos visto.
Y por eso no constituye ningún gran cambio, que el juicio que ahora se va a adelantar es de carácter político y no penal o jurídico para que sea más ágil. ¿Acaso no es eso lo que viene haciendo la desprestigiada Comisión con algunos procesos de los miles que tienen represados en los anaqueles del olvido, porque el juicio penal se adelanta en la Corte Suprema de Justicia? Como es eso de que puedan adelantar un proceso exclusivamente político sin connotaciones jurídicas como lo afirma ingenuamente la ministra, cuando esta clase de procesos y cualquier otro tienen necesariamente ingredientes jurídicos, porque hay que adelantarlos con observancia del debido proceso.
Cómo se puede sostener, que se le va a suprimir el ingrediente penal porque es la causa de que lleven años los procesos sin resolver, -cuando es por la ineptitud de los comisionados-, pero se habilita un cuerpo investigador de fiscales para que entregue un informe sobre el resultado de las averiguaciones sobre un aforado como el Fiscal que es el superior de estos fiscales. Lo dicho, cambiar las cosas para que sigan igual en materia de impunidad para los aforados, que solo se entiende en la imposibilidad que tiene el Congreso de crear una Comisión autónoma porque sustituye la Carta, como ya lo dijo la Corte Constitucional.

No deja de ser infame, que un columnista de este periódico, por razones de vindicta, siga agrediendo con saña, la honra y el buen nombre del ex presidente de la Corte Suprema de Justicia, Yesid Ramírez Bastidas, ícono de la lucha judicial contra la plaga criminal y siniestra de la parapolítica, minando con artería el noble ejercicio del periodismo.
