La constitución del 91, previó y consagró derechos sociales colectivos. El constituyente primario, debe utilizarlos para lograr el cumplimiento de los derechos fundamentales y colectivos, cuando los gobernantes no lo hacen o deniegan.
Son derechos colectivos: disponer de un ordenamiento institucional y una estructura de poder legal, capaces de garantizar desarrollo socioeconómico integral de la nación y de todos sus ciudadanos.
Colombia está sumida en crisis endémica socioeconómica, ética, moral, institucional y de poder público. La solución exige que el constituyente primario reconozca y se apersone del problema y utilice los recursos legales y constitucionales para ordenar al gobierno tomar y aplicar decisiones que corrijan errores, omisiones, laxitudes e irresponsabilidades del ordenamiento legal y sus intérpretes y ejecutores. Hasta hoy (más de 200 años), los representantes del poder público han sido incapaces de ejercer un gobierno, social y políticamente responsable.
El ordenamiento institucional, sus intérpretes y ejecutores, son laxos, permisivos, inequitativos, en muchos casos tendenciosos y desgraciadamente, permeados por el clientelismo, la politiquería y la corrupción.
Son condiciones que propician procedimientos sesgados, favoritismo, impunidad y denegación de justicia. Son factores que impiden el desarrollo integral nacional y la aplicación de justicia real.
Del resultado de la consulta popular del pasado domingo se concluye:
Se logró un verdadero triunfo político pero no jurídico. Más del 98% votó sí, sobre el contenido de las preguntas. Eso constituye un mensaje fuerte al régimen, pero no suficiente. El régimen esta cooptado por corrupción, inmoralidad y perversidad.
La corrupción, la politiquería, el clientelismo y mediocridad intelectual-administrativa han penetrado todas las instancias del poder y degradado catastróficamente la cultura ciudadana. Es causa fundamental de la abstención electoral e indiferencia social.
Dicen y se pregonan, que en una democracia, el pueblo, es decir el constituyente primario es soberano. Es esencia de la democracia. Y es el derecho y poder que el pueblo debe hacer valer, para liberarse de los politiqueros corruptos e irresponsables que llegan al poder.
Aunque el voto no es jurídicamente obligatorio, socialmente debe serlo, porque así se participa en las decisiones del poder. La dirigencia política aún honesta y quienes disponen de información y conocimientos sobre el ejercicio del poder, tienen obligación de instruir a quienes puedan tener dificultad para entender el sentido de la participación electoral.
La consulta popular es herramienta legal para defender derechos ciudadanos.
La inequidad socioeconómica, la concentración de la riqueza, el desempleo, la corrupción, la impunidad, la venalidad de la institucionalidad, la laxitud y permisividad del ordenamiento legal y de su aplicación, puede el constituyente primario, a través de Consultas Populares, ordenar al poder institucional introducir y aplicar los correctivos necesarios, para redimir el marco legal del poder público.
Es imperativo hacer un revolcón al ordenamiento legal y a la estructura del poder público.
El constituyente primario debe hacerlo y puede, si participa y entiende sus deberes sociales y legales. Las consultas populares son herramienta, para derrotar a la élite y la perversidad del poder.
